MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> APRIL 22,2020 <br /> Mr. Furbush mentioned that he viewed the lot and wanted to know about the vegetated <br /> buffer along the fence area that separates the proposed lot and the neighbor's chicken coop. <br /> He read footnote (14) Section 174-31 and asked Kevin Kirrane to comment. <br /> Mr. Kirrane said that the site plan depicts 19 ft. from the lot line to the row of evergreens. <br /> He said that his client would be prepared to vegetate that 10 ft., but said it is part of the lot <br /> and was left natural. He cannot determine what is on the other side of the fence. <br /> Jonathan asked if the fence was on the lot line.Mr.Kirrane said according to the engineered <br /> site plan it is not on the lot line, but he's not a surveyor. <br /> Mr. Bonvie asked Jonathan if there was a motion made would he want wording to mention <br /> that there is a minimum of a 10 ft. vegetative area with no structure within it. <br /> Mr. Bonvie asked if Charlie Rowley looked at the application. Yes; he was given the <br /> revised site plan and will look at it. Mr. Bonvie asked Mr. Kirrane if he would allow the <br /> motion to include Charlie Rowley review the plans. Mr. Kirrane said that would be fine. <br /> Mr. Bonvie asked if the comments from Design and Plan Review comments dated January <br /> 21, 2020 can be included in the motion. Mr. Bonvie read the comments form Plan Review <br /> into the record. <br /> Charlie said that a majority of Plan Review there is no question about whether or not if <br /> they have to follow codes or State regulations or Mass General Law regardless of what the <br /> Zoning Board says. When the applicant applies for a Building Permit they have to meet a <br /> majority of those recommendations. They have to meet the codes. <br /> Mr. Bonvie said that someone specifically asked that these recommendations be included <br /> for the ZBA. Charlie respectfully asked that the Board only discuss Zoning and not building <br /> inspectional and code issues. Charlie said he will not issue a permit if there is no sign off <br /> from the inspectional services. <br /> Mr. Furbush reviewed the comments from Design Review dated February 4, 2020 which <br /> will be included in the motion. Bill Blaisdell agreed to add the conditions recommended in <br /> the minutes. Mr. Furbush and Mr. Blaisdell agreed to exclude the Plan Review meeting <br /> minutes. <br /> Charlie explained that Plan Review is for the applicants to discuss their inspectional <br /> services from each department, i.e., Board of Health, DPW, Fire, Building, and <br /> Conservation Departments. The Design Review committee includes recommendations for <br /> the Zoning Board. <br /> Mr. Furbush read the motion that was made at Plan Review dated January 21, 2020 into <br /> the record and wants those recommendations included into the Zoning Board motion.
