Veronica Warden moved to accept the withdrawal of the second variance request for the depth <br /> to the field. Motion seconded by Brian Baumgaertel. Roll call vote: Brian Baumgaertel (yes); <br /> Veronica Warden (yes). VOTE: Unanimous (2-0). <br /> Veronica Warden moved to approve the septic system at 10 Evergreen Circle with a FAST <br /> denitrification unit,and with the condition that field testing be performed twice a year and, upon <br /> sale of the property,the reserve area shall be installed and the formal variance request shall be <br /> submitted. Motion seconded by Brian Baumgaertel. <br /> Veronica Warden moved to amend her previous motion to include the requirement that an <br /> Enforceable Agreement shall be filed at the Registry of Deeds stating that the reserve area shall <br /> be installed upon sale of the property,and replacing the twice yearly field testing requirement to <br /> a twice yearly maintenance requirement. Motion seconded by Brian Baumgaertel. Roll call vote: <br /> Brian Baumgaertel (yes);Veronica Warden (yes). VOTE: Unanimous(2-0). <br /> Ms. Warden reminded Mr. Aggerbeck that he needs to submit the amended Operations & <br /> Maintenance Agreement,as well as the recorded Enforceable Agreement,prior to issuance of the <br /> Certificate of Compliance. <br /> 4. Review of Board of Health emergency order/regulation relative to mandatory wearing of <br /> masks. Chair Baumgaertel stated that he received correspondence from the Chairman of the <br /> Board of Selectmen, which included a copy of a regulation from the Town of Westport that <br /> required the wearing of masks by everyone when they are in public. <br /> Mr. Harrington commented that two versions of the emergency order had been prepared, one <br /> applied to employees in essential businesses only,and the other applied to employees in essential <br /> businesses and the public when in essential business. <br /> Ms.Warden asked if Mr. Harrington had spoken to the Police Chief about enforcement, and Mr. <br /> Harrington answered in the affirmative. The Police Chief informed the Health Agent that he <br /> preferred to have a discussion after reviewing the final approved Emergency Order. Chief Carline <br /> further suggested issuing an advisory in lieu of an order or regulation. Chair Baumgaertel stated <br /> that a mask requirement for essential employees only could be enforced by the Board of Health, <br /> but a mask requirement for the general public would be difficult to enforce without involving the <br /> PD. <br /> Ms. Warden went on record as not supporting the order that included the public in essential <br /> businesses, as not everyone has access to masks. Chair Baumgaertel was in agreement, stating <br /> that he's seen pretty good voluntary compliance from the public already without making it a <br /> requirement. He further stated that he did not consider plastic face shields an adequate face <br /> covering for respiratory protection. Ms. Warden was In agreement on that point. <br /> Mr. Harrington asked Board members if essential employees would include all essential services <br /> or just those that the Board of Health permits, and Chair Baumgaertel and Ms. Warden agreed <br /> that it should include employees of all essential services. Board members agreed that exceptions, <br /> such as for medical conditions, would not be addressed in the order. Chair Baumgaertel <br /> suggested that the order listthe Mashpee Board of Health or its Agents,or other designees,under <br /> enforcement, so it would not be necessary to amend the order to add the PD as enforcement <br /> officials. <br /> 5 <br />
