Mr. Harrington commented that, after discussing
the property with Town Counsel in Executive Session,the Board has been directed to review any
previously issued orders provided to Cabral Service, and issue a final order to the owner of the
land at#95 Echo Road, as the pile of refuse is located on that property.
Mr. Harrington summarized by stating that,to address the violations, an order letter was issued
to Manuel Cabral,Cabral's Container Service,dated October 15,2019,which required the removal
of the refuse within 30 days of receipt of the notice. The 30-day timeframe was exceeded;
therefore, letters dated November 18, 2019, January 30, 2020 and February 13, 2020 were
provided, notifying Mr.Cabral that his license to haul may be revoked and/or fines may be issued.
On February 24, 2020, the Board issued a Cease & Desist by denying the issuance of the 2020
Refuse Hauler's License, and issued $23,000 in fines for non-compliance along with an order to
coverthe waste pile. To date,Cabral Container Service has failed to take any nuisance abatement
action in response to these orders, and recently ceased all communication with the Town.
Accordingly,this inaction and neglect bythe property owner/occupant,and the ongoing unabated
nuisance conditions at the subject property, leave the Board with no option but to pursue self-
abatement action in accordance with Board of Health Nuisance Control Regulation Part VIII,
Section 5.00(V.
