<br /> Chair Brian Baumgaertel called the meeting to order at 7:02 PM, and stated for the record that all Board
<br /> members were participating remotely.
<br /> OLD BUSINESS
<br /> 1. Review of compliance— 81 &95 Echo Road. Mr. Harrington commented that, after discussing
<br /> the property with Town Counsel in Executive Session,the Board has been directed to review any
<br /> previously issued orders provided to Cabral Service, and issue a final order to the owner of the
<br /> land at#95 Echo Road, as the pile of refuse is located on that property.
<br /> Mr. Harrington summarized by stating that,to address the violations, an order letter was issued
<br /> to Manuel Cabral,Cabral's Container Service,dated October 15,2019,which required the removal
<br /> of the refuse within 30 days of receipt of the notice. The 30-day timeframe was exceeded;
<br /> therefore, letters dated November 18, 2019, January 30, 2020 and February 13, 2020 were
<br /> provided, notifying Mr.Cabral that his license to haul may be revoked and/or fines may be issued.
<br /> On February 24, 2020, the Board issued a Cease & Desist by denying the issuance of the 2020
<br /> Refuse Hauler's License, and issued $23,000 in fines for non-compliance along with an order to
<br /> coverthe waste pile. To date,Cabral Container Service has failed to take any nuisance abatement
<br /> action in response to these orders, and recently ceased all communication with the Town.
<br /> Accordingly,this inaction and neglect bythe property owner/occupant,and the ongoing unabated
<br /> nuisance conditions at the subject property, leave the Board with no option but to pursue self-
<br /> abatement action in accordance with Board of Health Nuisance Control Regulation Part VIII,
<br /> Section 5.00(V. Enforcement)and General Laws, Chapter 111,Sections 122 thru 125.
<br /> There being no further comments or discussion,Veronica Warden moved to declare the extensive
<br /> accumulation of debris and waste stockpiled at the real property identified as 95 Echo Road,
<br /> Mashpee, MA as described in the Deed recorded at the Barnstable County Registry of Deeds in
<br /> Book 27922, Page, 35 (Mashpee Assessor's Parcel ID 19-3-0), presently believed to be owned by
<br /> Manuel Cabral, Trustee of Limited Realty Trust, to be a nuisance, source of filth and potential
<br /> cause of sickness in the Town, which, in the opinion of the Board, may be injurious to public
<br /> health;accordingly, pursuant to the authority vested in the Board by the provisions of G.L.c. 111,
<br /> Sections 122 through 125, Board of Health Nuisance Control Regulation, Part VIII, Section 5.00,
<br /> and any other enabling authority,the Board hereby directs that the Health Agent,in consultation
<br /> with Town Counsel, prepare and serve upon the owner/occupant of the subject property a FINAL
