*DRAFT* BOARD OF SELECTMEN MINUTES AUGUST 10, 2020* 5 <br /> Board of Selectmen <br /> Minutes <br /> August 10, 2020 <br /> U date on Schqp in 0 <br /> gPlan- Scho Patricia De,Boer, School Committee Chair GporL p <br /> Schmidt:, (continued) -,— <br /> The Board of Selectmen agreed the School Department Is doing a commendable job navigating an 'impossible task. <br /> With the pandemic some school. systems are seeing an increase in enrollment as many residents are converting <br /> their second homes to primary residences which may create long term implications. When asked of the status of <br /> enrollment School Superintendent eBoer indicated the figures have not been finalized, however,there has been <br /> an uptake in the School Choice offering. <br /> It is the 'intention of the School Department to provide nutrition to the children in need. Although the schedule has <br /> not yet been determined, it was confirmed the weekly distribution of the school meal plan which includes breakfast <br /> and lunches would continue. <br /> D'I'scussion.of Host Community;,_A -eement Process: Town Planner Evan Lehrer: <br /> Evan Lehrer presented a proposal to the Board of Selectmen to formalize the application and review process for <br /> the review of marijuana establishments seeking Host Community Agreements. In the process a committee would <br /> review applications and supporting materials. This would be considered as a basis for the Board of Selectmen's <br /> review to ensure the high quality of operators who would be partners and collaborators, and those who would <br /> thoughtfully manage the real or perceived impacts to the community at large. <br /> so <br /> By a vote of town meeting marijuana establishments are allowed by special permit in all commercial and industrial <br /> zoning districts. Restrictions limit retail, to less than 20% of retail liquor licenses for consumption off-premises. <br /> Although there are no other specific restrictions imposed by the Board of Selectmen, the Board is not compelled to <br /> approve a license because there is no restriction. Currently, the Town holds (9) retail liquor licenses in the "fown <br /> of Mashpee. <br /> Mr. Lehrer indicated there are no specific restrictions regarding delivery. It was recommended the Board of <br /> Selectmen consider whether or not delivery is a license the Selectmen would entertain for future applicants. <br /> Discussion followed with respect to the definition of delivery. <br /> It was agreed that a specific ruling would be obtained from Town Counsel that constitutes the legal description of <br /> a Marijuana Deliver License*, (delivery to a consumer) and that of a Marijuana Transporter License. The Board of <br /> Selectmen agreed to consider a mechanism to restrict delivery. It was agreed an article would be considered for <br /> the October Town w Meeting arrant to prohibit marijuana delivery to a consumer. <br /> With the assistance of Town. Counsel, it was agreed for consistency that (1) template would be utilized for the <br /> application for a marijuana establishment:Most Community Agreement. It was noted the Type(s) of proposed <br /> establishments in the Application do not include Marijuana Delivery. <br /> Discussion followed regarding the marijuana establishment owners/operators who would be potential partners and <br /> collaborators with the Town of Mashpee and its community. An owner/operator who lacks sufficient experience <br /> or capitalization, or other factors may result in a negative impact to the community. In considering the process and <br /> application for a Host Community Agreement it was recommended that a listing of ownership and residency be <br /> provided. <br /> It was noted the Town Planner has engaged in conversation with two businesses. One of which has recently met <br /> with the Board of the Selectmen, the other is expected to meet with.the Board in the future. <br />
