MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 12,2020 <br /> Mr.Kirrane said that this question arose as a result of a conversation that Charlie had with <br /> either the contractor or the architect whereby Charlie and Evan both thought that this was <br /> not going to be a temporary solution. That the new building wasn't going to start until 18 <br /> months from now, and he thought this was resolved and made clear that the new building <br /> construction would commence simultaneously with the construction of these two <br /> temporary additions. Mr. Kirrane indicated in his written remarks there would be a base <br /> coat for the parking lot that was approved under the previous special permit modification <br /> so that there would be no questions relative to the availability of parking and queuing. He <br /> thought these questions were resolved. <br /> Charlie mentioned that the discussion was regarding the application for the full permit <br /> within the next few weeks, not just the parking lot.Attorney Kirrane wanted to make sure <br /> that the parking was done immediately while constructing the new building so there is no <br /> issue relative to parking. Charlie is concerned about how the decision would be written. <br /> Mr. Reiffarth said a specific date can be written to start construction of the building. <br /> Evan Lehrer, Town Planner asked Chairman Furbush if he could help clarify some <br /> questions. He said he had a discussion with Charlie and Town Counsel to merely suggest <br /> Counsel to assist in crafting language for a specific condition relative to the temporary <br /> nature of these buildings. He did speak with Counsel this date, but he was not able to <br /> provide that language today.Evan said he didn't see any issues with moving forward with <br /> an approval, but he wouldn't want the Board to move forward with an executed written <br /> decision until they have time to consume the condition that Town Counsel submits. He <br /> suggested that the Board either continue the hearing, or decide on an approval with a <br /> condition of the temporary buildings being removed within a set period of time. But he <br /> urged the Board to consider waiting for the language provided for the Board from Town <br /> Counsel. <br /> Jonathan agreed that the Board relies on information from the other Town Departments, <br /> and when necessary, from Town Counsel to provide guidance for these type of proposals. <br /> Mr. Blaisdell said he has no problem with what is being proposed, but agrees with Evan to <br /> wait for information from Town Counsel, and he believes that the applicant can return in <br /> two weeks for the Board to make a more reliable ruling. Scott Goldstein said that these <br /> temporary buildings were not originally approved as part of the decision,and he would like <br /> a condition that would protect them because he wouldn't want these temporary buildings <br /> to remain five or more years. <br /> Evan mentioned that is the exact question that was asked of Town Counsel. <br /> 8 <br />
