MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 12,2020 <br /> Jonathan asked Mr. Kirrane if he could give a time-frame when the buildings are going up <br /> and coming down. John Connell said they plan to start construction on the temporary <br /> buildings almost immediately. The temporary buildings are just a preliminary phase of the <br /> overall construction. The new building will take approximately 18 months if able to start <br /> construction by the end of this month as far as the design and engineering. The temporary <br /> buildings could potential have already started. <br /> Jonathan said if Town Counsel suggested that the temporary buildings are up for only two <br /> years, would that be possible. John said subject to his client's counsel that would be a <br /> comfortable indicated time-frame. <br /> Evan wanted to be careful with the language and said his wording was something as <br /> follows; approved 3,700 sq. ft. addition would be completed within 18 months under the <br /> date of the approval of this modification and the temporary structures permitted under said <br /> modification shall be removed prior to an occupancy permit is issued for that 3,700 sq. ft. <br /> addition. That is what he sent to Town Counsel, so he would understand what needs to be <br /> accomplished. The 18 months was a suggestion,but if the Board wants to consider another <br /> time-frame that would be fine,but the primary goal was to ensure that the temporary nature <br /> of these buildings remains temporary. He said that this is within the Light Industrial <br /> Overlay District, and there are certain design criteria that is required under the guidelines <br /> of the Cape Cod Commission. But the appropriate condition in the decision should be that <br /> the temporary nature of these buildings remain temporary. <br /> Ron asked if these temporary structures are going to be used to sell cannabis.Kevin Kirrane <br /> said one of the buildings will be used to sell cannabis. Ron does not like the idea that the <br /> sale of cannabis out of a temporary building that is creating revenue while the bigger <br /> building is being constructed. He has no problem with the temporary buildings for other <br /> purposes other than the sale of the cannabis, which would then motivate the contractor to <br /> complete the construction of the bigger building, and with a caveat that you cannot apply <br /> for an occupancy permit on the main building until the temporary buildings are removed. <br /> Evan said that he agreed with the concerns of the construction of the larger building, but <br /> the sale of cannabis is allowed in the temporary buildings as long as the Cannabis Control <br /> Commission is satisfied with the nature of the temporary structures, and that the Town has <br /> adequate protection with the appropriate conditions initiated by Town Counsel to satisfy <br /> the Board. <br /> John Connell was told as the Architect that the project is being done in phases so that the <br /> current medical dispensary remains open. <br /> Kevin O'Reilly said his intensions are to get into the main building as quickly as possible. <br /> Bill Blaisdell would prefer to wait for Town Counsel's wording. <br /> 9 <br />
