MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 12,2020 <br /> Charlie said the building permit application for the temporary structures was not included <br /> in the original special permit.He said there needs to be some careful wording. Both he and <br /> Evan did not see any wording mentioned in the special permit regarding the start of <br /> construction of the actual approved addition. They had a conference call with Town <br /> Counsel to discuss these temporary structures and wanted to get his wording that will <br /> guarantee that these temporary buildings would be removed in short order when the <br /> originally approved recreational marijuana addition is ready to be occupied. <br /> Jonathan asked about a scenario that could prevent the construction of the permanent <br /> building if there's a possible financial issue. Attorney Kirrane could not speculate about <br /> the"cannabis world",but whatever these two additions amount to are less than the addition <br /> that has already been approved. The two "wings" combined are approximately 800 sq. ft., <br /> and the addition that was approved was a 3,700 sq. ft. The Board has already approved the <br /> uses and a larger addition than what is being proposed.Mr.Kirrane said that these additions <br /> will fall within the prevue of the square footage of what the Board has already allowed <br /> with regard to the substantial addition.He said that only one of these"wings"is being used <br /> as part of the actual dispensary operation. The other small addition is being used as a <br /> restroom, kitchen, and office space for personnel. <br /> Jonathan asked if these proposed plans for these buildings were following Cape Cod <br /> Commission guidelines. <br /> John Connell said that these buildings are following all applicable codes including energy <br /> codes. If there's a specific Cape Cod Commission ordinance or requirement that might be <br /> specifically pertinent to this application he can address that, but the design of these <br /> buildings meets all code requirements including ADA. <br /> Charlie said that there's no question that they have to meet code requirements but zoning <br /> does deal with the issues that were mentioned. He said that he was waiting for Town <br /> Counsel to provide his comments for this meeting that would assure that these temporary <br /> buildings would not remain. This application would have to meet all inspectional services; <br /> Building,Fire, Board of Health, etc. The point is just zoning issues. <br /> Attorney Kirrane said that the concern is whether these buildings will be removed. The <br /> Board can condition anything, including removal of these buildings once the other building <br /> has been completed and prior to an occupancy permit is issued. The concern would be a <br /> violation of the decision. <br /> Jonathan asked Charlie if he was waiting for Town Counsel to provide the wording.Charlie <br /> said; yes. <br /> 7 <br />
