Development and, where applicable any regional land use regulatory entity, intended to limit <br /> wastewater flows to the amount authorized under zoning and wastewater regulations as of the date <br /> of the approval of the CWW. <br /> Any borrower on the 2010 IUP who wishes to seek 0%funding must submit documentation describing <br /> how conditions contained in the 5 provisions listed above are met for their project(s). MassDEP will review <br /> all submitted information to determine the project(s)' eligibility for the reduced rate financing prior to <br /> committing to permanent financing. MassDEP is developing regulations that will clarify and define the <br /> process for pursuing and attaining this reduced funding option. <br /> Program requirements <br /> As noted in the cover letter there are several program requirements that are particularly worthy of the readers' <br /> attention and those are highlighted in this section. <br /> • Principle Forgiveness <br /> In its 2010 SRF allocation, Congress required states to use a share of the.CW grant for additional loan subsidy. <br /> Additional subsidy is•defined by Congress as principle forgiveness, grants or negative interest loans. Congress <br /> required that 30% of the federal allocation above$lB go to cost reduction. Against a$2.1B national allocation, <br /> that works to 15.7%for additional subsidy. MassDEP proposes to use 15.7% of its grant ($10.36 M) as <br /> additional subsidy for projects on the final IUP to target two purposes: A) Renewable Energy Generation and B) <br /> certain Environmental Justice Communities. <br /> The Department will give priority to communities with below average Median Household Income as Identified <br /> by the EOEAA Environmental Justice Program bltp://mwA,.mass.gov/mgis/ei statewide.pdf. The 2010 Final <br /> IUP includes a proposed total expenditure of$148,164,340 for 29 projects in 22 Communities within the <br /> Commonwealth having Environmental Justice designation(s) listed as below 65% of the State's M L <br /> In addition proponents that include Renewable Energy generation as a component of the project are eligible for <br /> enhanced subsidy. Additional subsidy for Renewable Energy loans is against the cost of the energy technology <br /> and not the total project. <br /> • Timeliness <br /> Apportionment of the $10.36 million additional subsidy funding will be distributed over construction contracts <br /> that are executed by April 1,.2011. Award will be based on a prorated share of the total eligible cost of all of <br /> the subsidy-eligible projects that meet the deadline. The April 2011deadline insures that the forgiveness will be <br /> used in a timely manner. <br /> • Green Infrastructure <br /> Congress required that at least 20 % of the grant($13.83 M) will be dedicated to Green projects or components <br /> as defined by USEPA in the final 2010 IUP. MassDEP has identified and highlighted 16 projects on the Final <br /> IUP that meet EPA guidelines for Green Infrastructure, specifically energy-related components. The total value <br /> of those projects is well in excess of$13.83M. As noted previously, MassDEP recommends additional subsidy <br /> for those projects including renewable energy components and the standard 2% loan for energy efficiency <br /> measures. The Department will work with the proponents to identify utility rebates and other subsidies as may <br /> be appropriate for the projects. <br />
