Ms.Warden noted that this has been going on a very long time. Chair Baumgaertel agreed it was <br /> time for action, stating that the neighbors are looking for the Board to move on this. Mr. <br /> Harrington recommended getting Town Counsel's advice on the appropriate steps moving <br /> forward,and also determine how the Town Manager wants to proceed. Board members agreed <br /> it was prudent to request that Town Counsel review the matter and recommend the best course <br /> of action. <br /> There being no further comments or discussion,Veronica Warden moved to authorize the Health <br /> Agent to send this matter to Town Counsel for an opinion and possible issuance of a complaint in <br /> court. Motion seconded by Brian Baumgaertel. Roll call vote: Brian Baumgaertel(yes);Veronica <br /> Warden(yes). VOTE: Unanimous(2-0) <br /> 5. Review of Emergency Condemnation Order — 278 Meetinghouse Road, Mr. Harrington <br /> commented that,on August 25, 2020,the Health Office was contacted to perform an inspection <br /> at 278 Meetinghouse Road, as it was a reported hoarding situation where an elderly man passed <br /> away in the dwelling. The dwelling is a single-family dwelling. The Fire Department was on-site <br /> and allowed the Health Agent access to inspect the emergency situation.. Pictures were taken <br /> that depicted filth, accumulation of garbage and debris that restricted clean operation of the <br /> kitchen,sleeping and living area. An infestation of files,a heavy odor of filth and a deceased body <br /> was overwhelming,so the air quality was considered hazardous to any occupant. <br /> Ms.Warden asked if Mr. Harrington had been out to the property,and he answered that he had <br /> not, but the Assistant Health Agent had been out to the property and Mr. Harrington had seen <br /> the photos she had taken. <br /> There being no further comments or discussion,Veronica Warden moved to issue a finding that <br /> the dwelling at 278 Meetinghouse Road, Mashpee MA, is unfit for human habitation, and order <br /> an emergency condemnation. Motion seconded by Brian Baumgaertel. Roll call vote: Brian <br /> Baumgaertel(yes);Veronica Warden(yes). VOTE: Unanimous(2-0). <br /> 6. Review of letter of interest— Ernest Virgilio. Mr. Harrington commented that Mr. Virgilio has <br /> provided a letter of interest to serve on the Board of Health. He indicated that he personally <br /> knows of Mr. Virgilio's extensive building experience from his clerk of the works projects in the <br /> area. His knowledge of the Town, gathered while acting as the DPW Director and Emergency <br /> Manager,will be immediately applicable to the topics covered by the Board. Ms.Warden stated <br /> that she has known Mr.Virgilio for many years, and she believes he is more than qualified. Chair <br /> Baumgaertel thanked Mr.Virgilio for his interest. <br /> Mr.Virgilio,who was dialed in remotely,stated that he believed he could be of great help to the <br /> Board,and thanked them for their consideration. <br /> There being no further comments or discussion,Veronica Warden moved to recommend to the <br /> Board of Selectmen that Ernest Virgilio be appointed as a member of the Board of Health. Motion <br /> seconded by Brian Baumgaertel.
