Town of Nlashpee <br /> yZKY�•~ti if <br /> C 16 Great Week&ad Nwrt'h <br /> Alashpu?,Massachusetts 020.49 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> SEPTEMBER 23,2020 <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, September <br /> 23, 2020 at 6:00 p.m. in the Waquoit Room at the Mashpee Town Hall, 16 Great Neck <br /> Road North. Chairman, Jonathan D. Furbush, Board Members Ronald Bonvie, Scott <br /> Goldstein, Norman J. Gould and Associate Members Sharon Sangeleer, George <br /> Ganzenmuller, and James Reiffarth were present. Charlie Maintanis, Building Inspector, <br /> was also present. <br /> Chairman Furbush opened the meeting at 6:04 pm and announced that the hearings were <br /> being televised live on Mashpee TV as a virtual remote meeting. He will take public <br /> comments after each hearing. <br /> NEW HEARINGS <br /> 62 Cayuga Avenue: Owners, James T. Morahan, Jr. and Nancy Morahan request a <br /> Written Finding under§174-17 of the Zoning Bylaws to allow for construction of a second <br /> story addition and deck on property located in an R-3 Zoning District, Map 65 Parcel 10, <br /> Mashpee,MA. <br /> Attorney Kevin Kirrane represented the homeowner for the application. Also present was <br /> Dan O'Jala with Down Cape Engineer,Adam Moring who is the Engineer for the project, <br /> and Jim Morahan, homeowner. Attorney Kirrane provided the Board with a site plan <br /> showing the existing and proposed dwelling. The application is for a specific finding <br /> because it's an addition to an existing single-family residential structure. The lot is situated <br /> on a 10,000 plus square foot lot with 87 ft. of frontage along Cayuga Avenue and slopes <br /> down to John's Pond. The existing house is a single-story residential ranch style structure, <br /> consisting of five (5)rooms, and has three (3)bedrooms that was built in 1964. <br /> The dwelling itself is non-conforming because it sits only 36.9 ft. from Cayuga Ave, and <br /> 38.3 ft. from the edge of the wetland resource area. The front setback requirement is 40 ft. <br /> from front lot line, and the requirement from the pond is a 50 ft. setback. Under Section <br /> 174-17 the Board has the authority to grant a specific finding for the requested relief. <br /> The proposal consists of a second floor addition to the existing structure and will essentially <br /> be built within the footprint of the existing first floor with the exception of a 2 ft. overhang <br /> to the rear on the John's Pond side of the building with two decks. The first floor deck will <br /> be above the ground, and there will be a deck off the second floor addition. The structure <br /> itself is not getting any closer to wetlands because the 2 ft. overhang is not considered part <br /> of the setback criteria, but the two decks bring the building closer to the wetland resource <br /> area by 10 ft. There's no changes to the front yard setback, and there is no expansion on <br /> either side of the house. <br /> 1 <br />
