writing, by the parties, subject to available capacity in the CONTRACTOR'S <br /> Wastewater Treatment Plant as determined by the CONTRACTOR and contingent, <br /> upon issuance of all additional regulatory permits necessary to accommodate these <br /> additional flows and Cape Cod Commission.approval of nitrogen credits for the <br /> tie in of Phase II buildings. <br /> Coombs School 10,200 gpd <br /> Quashnet Middle School 11,500 gpd <br /> Quashnet Middle School Addition 3,495 gpd <br /> The parties furthermore aclmowledge and 'agree- that additional flows from Town <br /> properties may be generated in the future and the CONTRACTOR agrees to review the <br /> physical,and financial conditions for acceptance of such additional flows and shall <br /> decide, in its sole discretion, whether to accept such additional flows. <br /> 6.2 The volumes and characteristics of the TOwN'S Sewage received by the <br /> CONTRACTOR for treatment shall comply with and not exceed the standards set forth <br /> in the CONTRACTOR'S Groundwater Discharge Permit. The characteristics of the <br /> TOwN'S Sewage shall conform to the guidelines and conditions contained in Article <br /> 2.6. <br /> 6.3 The CONTRACTOR and/or the TOWN may review the capacities and flow in the <br /> Sewage work-s and wastewater Treatment Plant at any time at its sole expense. <br /> 7,0 Sewage Treatment Fees <br /> 7.1 The TOWN shall pay to the CONTRACTOR, in consideration of the wastewater <br /> treatment services to be provided hereunder, a User Fee based upon an equitable <br /> apportionment of the maintenance and operational costs of the wastewater Treatment <br /> Plan among all users thereof. Said maintenance and operational costs shall include, but <br /> are not limited to, system operator labor and/or service contract costs, energy costs, <br /> chemical purchase costs, monitoring, sampling and analytical service expenses. The <br /> applicable Title V daily flow capacities set aside for the Town Properties, as provided <br /> in Article 6. 1, shall be utilized to determine the allocation of maintenance and <br /> operational costs to the TOWN for User Fee calculation purposes. The TOWN, upon <br /> request to the CONTRACTOR, shall be provided a copy of the wastewater Treatment <br /> Plant annual operating budget and other documents in the possession of the <br /> 8 <br />
