MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> OCTOBER 14,2020 <br /> Mr. Bonvie mad a motion to issue a Written Finding to Petitioner, Ashbel White Joyal <br /> under §174-17 of the Zoning Bylaws to allow for reconstruction of a 12 ft. x 24 ft. deck to <br /> a pre-existing,non-conforming structure on property located in an R5 Zoning District,Map <br /> 50 Parcel 4,Mashpee, MA(Owner of Record: James and Sandra Loew)with the following <br /> conditions; <br /> 1. The non-conformity is currently 9.8 ft. on the side yard to the existing stairs. The <br /> owners are seeking to expand that non-conformity to 8.8 ft. for 1 ft. relief to this <br /> finding. <br /> 2. The Board has determined that the applicant meets all the conditions of a Written <br /> Finding under Mass General Law 40A Section 6. <br /> 3. .Plot Plan of Land Prepared for James and Sandra Loew showing proposed deck and <br /> stairs. 35 Highview Ave., Mashpee, MA. Cook request a Written Finding tinder <br /> §174-17 of the Zoning Bylaws to allow for extension, alteration of the upper deck to a pre- <br /> existing, non-conforming structure on property located in an R-3 Zoning District, Map 65 <br /> Parcel 38A, Mashpee, MA. <br /> Sitting on this hearing were the four regular Board members and Associate Member, <br /> George Ganzenmuller. <br /> Ralph and Susan Cook represented themselves for the petition to reconstruct their upper <br /> deck. They provided the Board with a site plan that depicted an existing deck attached to <br /> the dwelling structure that was permitted prior to their purchasing the home, and also <br /> included the proposed deck.The original deck was built approximately at the time the <br /> house was built back in 1999. The Certificate of Occupancy for the single family dwelling <br /> was issued in 2001. The Cook's purchased the home in 2002. <br /> 2 <br />
