within 150 feet of the shoreline, swimmers, postings, etc. This addresses the shoreline fish concern and
other traffic dangers, but again highlights the value in signage, which is non-existent within Ashumet
Pond.
§1'70-5 Water-skiing;'Tubing,Kneeboarding:
A, All water-skiing,tubing and kneeboarding is subject to the applicable provisions of the
General Laws of the Commonwealth,as amended, and to the further restriction that no
water-skiing,tubing or kneeboarding is allowed in Mashpee in or on the freshwater ponds
105
(with the exception of Mashpee-Wakeby Lake)before the hour of 10:00 am and after the
hour of 7:00 pm.
liistoa: Amended 10-16-2006,ATIt.Adi:de 32,approved by Attorney General 2-13-2007,
B. Water-skiing,tubing and kneeboarding is permitted on fresh water ponds and tidal waters
of Popponesset Bay, Nantucket Sound, and Waquoit Bay subject to the fallowing
restrictions:
l. Not within one hundred fifty(I SO')feel of:
(a) Shoreline, except where posted as permitted
(b) Swinuuers
(e) Watercraft underway by means other than motors
(d) Watcrcrufl not underway(for example moored or anchorW)
to) Areas with posted speed timid,
(1) Commercial docking or mooring areas
tg) Private docking or mooring areas
Water Use Safety-Furthermore,the section of the bylaws, shown below on Watercraft Speed limits the
speed of watercraft to "no wake" in areas 150 feet from shore or near moorings, etc. If that is the case,
much or all of the pond's southern basin, where the island is, would be a "no wake zone",which
contains almost all of the Falmouth section of the pond. The remaining Falmouth section is closest to
the State boat ramp, which could also be marked as a "no wake zone". It seems clear that appropriate
markings could address nearby noise, endangerment to wildlife, and address Falmouth's ban on jet skis
entirely, while leaving the rest of the large pond open to the enjoyment of clean healthy athletic fun.
7
