i ARTICLE 9. To see if the Town will vote to authorize Per order of, and direct the Selectmen to execute, acknowledge, seal and deliver an agreement in recordable form with New Andrew R. Gottlieb, Chairman Seabury Company Limited Partnership(successor to New Jeremy M. Carter Seabury Corporation, formerly Popponesset Corpora- Carol H. Jacobson tion) remodifying the restrictions contained in a deed Willard L. Hanson from Propponesset Corporation to the Town, dated Ju- Peter M. Lawrence ly 13, 1964,and duly registered in the Barnstable Registry BOARD OF SELECTMEN District of the Land Court as Document No. 92606, and contained in an"Agreement Modifying Restrictions"bet- ween New Seabury Corporation and the Town dated December 27, 1971, and duly registered in said District as Document No. 155216, so that: a) The number of dwelling units permitted in Section 5 on the Plan referred to in said deed shall be in- creased from 25 to 425. �i b)The number of square feet of commercial area per- ,I�,L mitted in Section 5 on the Plan referred to in said deed shall be increased from 180,000 to 340,000. c)The number of dwelling units permitted in Combined Sections 20, 23,24,25, and 26 on the Plan referred to in said deed shall be reduced from 959 to 559. d)The number of square feet of commercial area per- mitted in Combined Sections 20,23,24,25, and 26 on the Plan referred to in said deed shall be reduc- ed from 236,000 to 76,000. I e New I Seabury Company Limited Partnership tnership shall lace a conservation restriction enforceable p by the town Conservation Commission or a land trust approved by the Commission, on 30 acres of land, more or less, located in Combined Sections 20, 23, 24, 25, and 26, whereby said 30 acres shall be left in its natural vegetated state. The land to be so restricted shall be essentially that shown on a plan filed with the Town Clerk's Office and marked �I "30 Acre Conservation Restriction, New Seabury �1 Company Limited Partnership."
