Article 11 <br /> To see if the Town will vote to transfer the sum of$350,000 from the Assessors' Overlay Surplus Account <br /> to the Assessors' Revaluation Account. <br /> Submitted by the Board of Assessors <br /> Explanation: To transfer existing monies to the Assessor's Revaluation Account for costs related to <br /> meeting the Department of Revenue's certification requirements. All towns are required to maintain a <br /> revaluation account for costs relating to valuation consultants, Appellate Tax Board expenses, private <br /> appraisals, defense of values and various other requirements to ensure accurate assessments and timely <br /> issuance of tax bills. <br /> The Board of Selectmen recommends approval of Article 11 by a vote of 5-0 <br /> The Finance Committee recommends approval of Article 11 by a vote of 6-0 <br /> Motion Made By Selectman O'Hara <br /> Motion: I move that the Town vote to approve Articles 3, 10, 11 and 13 as printed in the Warrant, <br /> with the exception of the phrases "or take any other action relating thereto." <br /> Motion passes unanimously at 7:11 PM <br /> Article 12 <br /> To see if the Town will vote to appropriate and transfer the sum of$150,000 from revenue available for <br /> appropriation to the Board of Health Nuisance Remediation expense account. <br /> Submitted by the Board of Health <br /> Explanation: On October 15, 2019, the Board of Health issued an Order pursuant to the Board of Health <br /> Nuisance Regulation Part VIII Section 5.00 and G.L. c. 111, §123 that Cabral Container commence <br /> abatement of the nuisance violation of the accumulated refuse located at 81 Echo Road, Mashpee, MA <br /> within thirty (30) days from the date of said notice was received. No action complying with the Board's <br /> Order has been undertaken to date. Pursuant to the provisions of G.L. c. 111, §125,which authorizes local <br /> boards of health to"cause[a]nuisance,source of filth or cause of sickness to be removed"upon the property <br /> owner's failure to comply with an order that he or she do so, the Board proposes to proceed with the <br /> demolition/removal of the nuisance as the most reasonable and expeditious course of action to abate the <br /> nuisance conditions caused by this substantially abused and neglected property. All costs and expenses <br /> incurred by the Town in this regard shall constitute a debt owed to the Town upon the rendering of an <br /> account therefor, and shall be recoverable in an action of contract or by real property lien proceedings <br /> pursuant to M.G.L. c. 139. §3A. This action was deemed necessary by the Board due to the nuisance <br /> conditions and persistent refusal to address the same within the timeframes previously ordered. <br /> The Board of Selectmen recommends approval of Article 12 by a vote of 5-0 <br /> The Finance Committee recommends approval of Article 12 by a vote of 4-2 <br />
