%= IN v Town of Mashpee <br />w9 <br />1e 16 Great Ack Y(oad Anti <br />Mashpee, Massachusetts 02649 <br />MASHPEE ZONINC BOARD OF APPEALS <br />DECISION FOR A SPECIAL PERMIT <br />Re: Mashpee Realty Investors; LLC 19 Sand Dollar Lane <br />Owner: Stanley -Evans Realty "frust Map t05/91 Parcel 51 <br />SP -05-18 <br />A Petition was filed on January H, 2005 for a Special Permit under Section 174- <br />20 of the Zoning By-laws in order to demolish a pre-existing non -conforming structure <br />and build a new house on property located in an R-3 zoning district at 19 Sand Dollar <br />Lane (Map 105/91 Parcel 51) Mashpee. MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />• newspaper of general circulation in the Town of Mashpee, on January 14, 2005 and <br />.January 21, 2005, a copy of which is attached hereto and made a part hereof. <br />A Public 1-learing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, February 2; 2005 and continued until February 23, 2005: at which time the <br />following members of the Zoning Board of Appeals were present and acting throughout: <br />Robert Nelson, Zella Elizenberry, Richard Guerrera and Frederick Borgeson. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br />Mashpee Zoning By-laws. <br />Mr. Timothy Luff represents the petitioner at this hearing. They are requesting a <br />special permit in order to tear down the existing dwelling and rebuild a new dwelling. <br />They will need variance relief as well and must continue the hearing on this matter until <br />the petitioner can change the variance request to accommodate the Board's wishes. <br />During the final hearing, the Board reviews the plans again and feels everything is in <br />order to move forward on the special permit. A motion is made and seconded to grant the <br />• special permit. <br />
