Town of Mashpee <br />a r'""•, us <br />MASHPEE ZONING BOARD OF APPEAL it Great slack �gacl 02649 <br />�fforth <br />eu�cw t�7ash�ee, Massachusetts 02649 <br />Decision for a Variance <br />RE: James Quigley. 130 Summersea Road <br />Map 105 Parcel 55 <br />V-05-22 <br />A Petition was filed on January 10, 2005 for a Variance from Section 174-31 of <br />the Zoning By-laws to vary the setback requirements and landspace requirement in order <br />to demolish the existing dwelling and rebuild a new three bedroom dwelling <br />on property located in an R-3 zoning district at 130 Summersea (Map 105 Block 55) <br />Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br />a newspaper of general circulation on January 14, 2005 and January 21, 2005 a copy of <br />which is attached hereto and made a part in the Town of Mashpee, on hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, February 2, 2005 at which time the following members of the Zoning Board <br />of Appeals were present and acting throughout: James Regan, Robert Nelson and Zella <br />Elizenberry, Evano Cunha and Frederick Borgeson.. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />John Slavinsky of Cape & Islands Engineering represents the petitioner. He is <br />seeking a variance from the setback requirements and landspace requirements in order to <br />demolish and rebuild a three-bedroom house. They will be installing a new <br />denitrification system for the septic and Conservation Commission has approved the <br />project. The Board moves to grant the following: <br />✓ A 3.2 foot variance on the southerly side <br />• ✓ A 5 foot variance on the northerly side <br />✓ An 18.2 foot variance from Summersea Road <br />
