• <br />• <br />0 <br />Mashpee Zoning Thomas Belekewicz 2 <br />Board of Appeals Owner: Merope Deluca <br />SP -04-169 and SP -05-2.0 <br />cui rently exists in the neighborhood and is well under the 20% lot coverage as it would <br />be 11%. Attorney Kirrane feels that section 174-17 of the by-law addresses the proposed <br />project without the need for any variance relief. The Board discusses the plans and feels <br />that since the Variance has been filed, they will address the relief requested. The Board <br />feels this will be an improvement to the neighborhood and will not be more detrimental <br />than what currently exists there now. An abutter, Arthur Brecker of 57 Pickerel Cove <br />Road is in full support of this project. He feels the new septic system is better for the <br />pond and the neighbors are in full support. The Board seems to be in agreement with the <br />requests. The Board moves to grant the Special Permit under both section 174-17 and <br />section 174-20 of the zoning by-laws. <br />GENERAL FINDINGS <br />1. that the subject property is located at 53 Pickerel Cove Road and contains <br />26,700 square feet. <br />SPECIFIC FINDINGS <br />Per § 174-24 of the Zoning By-laws, the Board determined that the proposed use or <br />development: <br />I . is consistent with applicable state and town regulations, statutes, bylaws and <br />plans. <br />2. will not adversely affect public health or safety. <br />3. will not cause excessive demand on community facilities. <br />4. will not significantly decrease surface or groundwater quality or air quality. <br />5. will not have a significant adverse impact on wildlife habitat, estuarine <br />systems, traffic flow, traffic safety, waterways, fisheries, public lands or <br />neighboring properties. <br />6. will not cause excessive levels of noise, vibrations, electrical disturbance, <br />radioactivity or glare. <br />7. will not destroy or disrupt any species listed as rare, endangered or threatened <br />by the Massachusetts Natural Heritage Program or any known historic or <br />archaeologic site. <br />8. will bean improvement with installation of anew Title V septic system. <br />
