Town of Mashpee <br />16 Great Aeck qtoad Arooh <br />MASHPEE ZONING BOARD OF APPEALash�ee, lYlassachusetts 02649 <br />Decision for a Variance <br />RE: Richard Furlani. <br />35 Bayview Road <br />Map 119 Parcel 129 <br />V-05-14 <br />A Petition was filed on January 5, 2005 for a Variance from Section 174-31 of the <br />Zoning By-laws to vary the maximum lot coverage in order to build 2 handicapped <br />bedrooms with handicapped bathrooms on property located in an R-3 zoning district at 35 <br />Bayview Road (Map 119 Block 129) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br />a newspaper of general circulation on January 14, 2005 and January 21, 2005 a copy of <br />• which is attached hereto and made a part in the Town of Mashpee, on hereof. <br />A Public Hearing was held on the Petition at the Mashpec Town Hall un <br />Wednesday, February 2, 2005 at which time the following members of the Zoning Board <br />of Appeals were present and acting throughout: James Regan, Robert Nelson and Zella <br />Elizenberry, Jonathan Furbush and Frederick Borgeson.. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />Richard Furlani represents himself at this hearing. He is seeking a lot coverage <br />variance in order to build two handicapped bedrooms and a handicapped bathroom. He <br />has two daughters with Sanfiillipo disease and they would like to build this for them to <br />keep them out of a nursing home. They will both be wheelchair bound very shortly but <br />this addition would put them over the 20% maximum that the Board generally imposes <br />on new dwellings. The Board feels that since this is a medical necessity and special <br />circumstance that they will grant the 4.2% lot coverage variance. <br />• <br />
