Town of Mashpee 16 Great Aeck qtoad Arooh MASHPEE ZONING BOARD OF APPEALash�ee, lYlassachusetts 02649 Decision for a Variance RE: Richard Furlani. 35 Bayview Road Map 119 Parcel 129 V-05-14 A Petition was filed on January 5, 2005 for a Variance from Section 174-31 of the Zoning By-laws to vary the maximum lot coverage in order to build 2 handicapped bedrooms with handicapped bathrooms on property located in an R-3 zoning district at 35 Bayview Road (Map 119 Block 129) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation on January 14, 2005 and January 21, 2005 a copy of • which is attached hereto and made a part in the Town of Mashpee, on hereof. A Public Hearing was held on the Petition at the Mashpec Town Hall un Wednesday, February 2, 2005 at which time the following members of the Zoning Board of Appeals were present and acting throughout: James Regan, Robert Nelson and Zella Elizenberry, Jonathan Furbush and Frederick Borgeson.. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of Mashpee Zoning By-laws. Richard Furlani represents himself at this hearing. He is seeking a lot coverage variance in order to build two handicapped bedrooms and a handicapped bathroom. He has two daughters with Sanfiillipo disease and they would like to build this for them to keep them out of a nursing home. They will both be wheelchair bound very shortly but this addition would put them over the 20% maximum that the Board generally imposes on new dwellings. The Board feels that since this is a medical necessity and special circumstance that they will grant the 4.2% lot coverage variance. •
