Town of Mashpee <br />16 Great Xeckload North <br />1Jlasilpee, Massachusetts 02649 <br />MASHPEE ZONING BOARD OF APPEALS <br />Decision for a Variance <br />RE: James Archibald <br />422 Cotuit/Sandwich Road <br />Map 22 Parcel 44 <br />V-05-15 <br />A Petition was filed on .January 1 I, 2005 by James Archibald for a Variance from <br />Section 174-31 of the Zoning By-laws to vary the current setback requirements in order <br />to build an addition on property located in an R-5 zoning district at 422 Cotuit/Sandwich <br />Road (Map 22 Block 44) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br />a newspaper of general circulation on January 14, 2005 and January 21, 2005 a copy of <br />which is attached hereto and made a part in the Town of Mashpee, on hereof. <br />• A Public Hearing was held on the Petition at the Mashpee Town Idall on <br />Wednesday, February 2, 2005 at which time the following members of the Zoning Board <br />of Appeals were present and acting throughout: James Regan, Robert Nelson and Zella <br />Elizenberry.Jonathan Furbush and Frederick Borgeson. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws Chapter 40A Section 10 and the ToNm of <br />Mashpee Zoning By-laws. <br />Mr. Archibald along with his builder Nick Lagadinos represent themselves at this <br />hearing. They are seeking a variance in order to build a master bedroom. The Board of <br />Health has approved this project. Since the zoning has changed they are unable to meet <br />the 25 -foot setback requirement. The Board moves to grant an 8.1 -foot variance on the <br />northerly side. <br />GENERAL FINDINGS <br />1. that the subject property is located at 422 Cotuit/Sandwich Road and contains <br />14,086 square feet. <br />is <br />
