>r May 29, 1963
?79
Mr. Charles H. McGrath
28 Barnstable Road
Hyannis,,_ Massachusetts
Dear Mr. McGrath:
Leo M. Aiken, Selectman of the Town of Mashpee, dropped by my office
this date inquiring about the Mashpee 'by-laws. Enclosed you will find
carbon of letter to the Town Clerk requesting some information I need
prior to approval of same.
In addition to the procedural information outlined in my'lette
Town Clerk, I am somewhat concerned about Article 61 relative r to the
establishing a cluster zoning district, in that it would appear that a
developer in order to proceed thereunder, must have registered land.
I do not understand why the requirement that the land be registered was
inserted in this Article, and it would seem to discriminate against
developers of registered land.
However, in as much as I agree with the
purpose of the article, I hesitate
to disapprove it for this reason alone, and would welcome your thoughts
relative to same.
r t y ys,
JOHN E. SULL AN
JES:ty siStant Attorney General
Enclosure
f r1
i
