Motion made by Selectman Wayne Taylor. <br /> Motion.- I move Article 21 be voted as printed in the warrant, except for the phrase "or take any <br /> other action relating thereto", and that said provisions of General Law Chapter 39, Section 23D <br /> be applicable to all adjudicatory hearings conducted by multiple member boards, committees or <br /> commissions of the Town of Mashpee. <br /> Motion passes unanimously at 8:07 PM. <br /> Article 22 <br /> To see if the Town will vote to amend the Zoning By-law by amending Section 174-21.A. by <br /> adding the following sentence: <br /> "In addition, building lots created by a subdivision plan endorsed by the Planning Board under <br /> the provisions of Chapter 41, Section 81-U may be developed pursuant to the lot size, frontage <br /> and setback regulations applicable to the original approval of said subdivision if, within eight (8) <br /> years of the date of said endorsement, the performance guarantee required by said Section 81-U <br /> was released regarding said of and said lot became separately owned from all adjacent land." <br /> or take any other action relating thereto. <br /> Submitted by Planning Board <br /> Explanation: This article would "grandfather" lots previously approved by the Planning Board <br /> for which subdivision streets were completed within 8 years of signature of the subdivision plan <br /> by the Board, and which became separately owned from all the adjacent land within that 8 year <br /> period. It would make certain lots buildable that otherwise could not be built on or would <br /> require variances from the Zoning Board of Appeals. <br /> The Board of Selectmen recommends approval. <br /> The Finance Committee recommends approval by a vote of 4-0. <br /> Planning Board voted at a Public Hearing held on September 20, 2006 5-0 to recommend <br /> approval. <br /> Motion made by Selectman Theresa Cook. <br /> Motion-. I more Article 22 be voted as printed in the warrant, except for the phrase "or take any <br /> other action relating thereto' <br /> Motion passes by 2/3rds vote at 8:09PM, <br /> Article 23 <br /> To see if the Town will vote to amend the Zoning By-law by amending Section 174-21 by <br /> adding a new Subsection D. as follows: <br /> 17 <br />
