Article 13 <br /> To see if the Town will vote to amend Section 174-31 of the Zoning Bylaw, the Land Space <br /> Requirements Table, by adding a reference to footnote 23 at the head of the "Rear" and "Side" <br /> Setback columns and by adding the following new footnote 23: <br /> "23 Minimum required setback from rear or side property lines shall be five (5) feet for sheds or <br /> similar non-habitable structures not exceeding 120 square feet in floor area or 12 feet in height", <br /> or take any other action relating thereto. <br /> Submitted by the Planning Board <br /> Explanation: Currently sheds must meet the sideline requirement of either a fifteen (1. or <br /> twenty five (25) foot setback from the rear or side line. It becomes difficult on small lots to <br /> locate small sheds, either because the setback requirement would place the shed in the middle of <br /> their yard, over their septic system or require them to apply to the Board of Appeals for a <br /> variance. Allowing a five (5) foot setback from the rear or side property line will ease the <br /> restriction on small structures (sheds) where it is impossible to meet current setback <br /> requirements. <br /> The Board of Selectmen and the Finance Committee recommend approval. <br /> Planning Board voted at a Public Hearing held on October 5, 2005 4-0 to recommend <br /> approval. <br /> Motion made by John Cahalane. <br /> Motion: I move Article 13 be voted as printed in the warrant, except for the phrase "or take any <br /> other action relating thereto". <br /> Town Moderator declares motion passes by a 2/3rds vote at 8,36PM, <br /> Motion made by George Baker to reconsider Article 12 at 8:36 PNI <br /> Motion to reconsider Article 12 passes at 8:36PM. <br /> Motion made amend back to its original form. <br /> Motion to amend back to original for passes at 837PM. <br /> Amended motion for Article 12 passes by a majority vote at 8:39PM <br /> Article 14 <br /> To see if the Town will vote to amend the zoning bylaw by amending Subsection 174-79.B. to <br /> add a new subsection (6) as follows: <br /> 13 <br />
