C. The salary classification of full-time and part-time positions may be modified at <br /> Annual Town Meetings by majority vote. <br /> D. The salary classification of full-time and part-time positions may be modified at <br /> Special Town Meetings by a two-thirds vote and only if the Board of Selectmen, <br /> following consultation with the Finance Committee, has determined by a four- <br /> fifths vote that the purpose of the reclassification is extraordinary. <br /> History: Added 12-2-1985 STM,Article 53,approved by Attorney General on 2-11-1986. <br /> History-, Amended-1-1989 STM,Article 59,approved by Attorney General on 7-5-19-1989. <br /> §5-8. Appropriation for Fringe Benefits: No new full-time or regular part-time position <br /> may be created or filled by any board or official of the Town except in conformity <br /> with the Personnel Administration Plan, if applicable, and unless the Town Meeting <br /> article creating or upgrading the position from part-time to full-time 'includes an <br /> appropriation for fringe benefits for the first fiscal year. For purposes of this section, <br /> "fringe benefits" shall consist of any medical insurance, life insurance and pension <br /> 'reserve fund payments as the Treasurer determines are needed. Nothing in this <br /> section shall change the percentage of medical and life insurance payments for Town <br /> employees previously authorized by the Town. <br /> History: Added 8-25-1986 STM,Article 53,approved by Attorney General on 10-17-1986. <br /> ARTICLE III — Treasurer/ Tax Collector <br /> History: Adopted as Ch.2,Article 2.2,of the 1980 Code <br /> §5-9., Appointment; Term of Office. The Treasurer/ Tax Collector shall be appointed by <br /> the Town Manager for a term to be determined by the Town Manager. <br /> §540. Authority to Engage Legal Counsel. The Treasurer is authorized to engage counsel at <br /> expense of the Town for the purpose of prosecuting any action at law under the <br /> provisions of the public statutes relating to suits on bonds, notes or other securities. <br /> §5-11. Statutory Duties. The Treasurer/Collector of Taxes shall carry out all duties, <br /> functions and obligations imposed on him by the General Laws of the <br /> Commonwealth. <br /> §542. Additional Duties,. The Treasurer/Collector of Taxes, ex-officio, shall be the Town <br /> Collector, and it shall be his duty under the title of Town Collector to collect all <br /> accounts due and payable to, the Town, excepting interests on investments of sinking <br /> or trust funds, the collection of which is not otherwise provided for by statute, bylaw <br /> or vote of the Town. <br /> §543. Action Upon Inability to Collect. If the Town. Collector is unable to make prompt <br /> collection of the accounts committed to him/her under this Article, he/she shall so <br /> certify to the Selectmen, who shall enforce collection by suit or otherwise, in <br /> accordance with the provisions of the statutes and the bylaws of the Town. <br /> 21 <br />
