Groundwater Protection District and this article would help fulfill the original purpose of the <br /> district to protect groundwater resources. The taking would perfect the Town's title to the land <br /> and restrict it to conservation use. Should the Town's taking price of one dollar be successfully <br /> challenged in court by some party which can legally establish ownership rights despite the <br /> previous Town tax taking, additional funding may be required at a future Town Meeting. <br /> Motion to be made by Petitioner <br /> Motion made to dispense with reading of article. <br /> Motion made to indefinitely postpone. <br /> Motion to indefinitely postpone passes at 10:22 p.m. <br /> Article 42 <br /> To see if the Town will vote to authorize the Selectmen to acquire, by eminent domain, for <br /> conservation purposes, those parcels of land shown on the 1999 Mashpee Assessors' Maps as <br /> Map 38,, Block 25, containing 27,325 square feet, more or less, located east of the Santuit River <br /> and described at Barnstable County Registry of Deeds Book 11156, Page 236, with the land to <br /> be held in the care and custody of the Conservation Commission pursuant to Massachusetts <br /> General Laws Chapter 40, Section 8C; and further, to see if the Town will vote to raise and <br /> appropriate from available funds, one dollar for such purpose; and finally, to see if the Town <br /> will authorize the Conservation Commission and the Board of Selectmen to enter into <br /> agreements and execute any and all instruments as may be necessary on behalf of the Town to <br /> effectuate said acquisition; or take any other action related thereto. <br /> Submitted by Petition <br /> Explanation: This article would authorize the Board of Selectmen to purchase by eminent <br /> domain, on behalf of the Conservation Commission, a parcel of land previously taken for taxes <br /> in the area of the proposed "Cape Club" golf course. The parcel is also located in the <br /> Groundwater Protection District and this article would help fulfill the original purpose of the <br /> district to protect groundwater resources. The taking would perfect the Town's title to the land <br /> and restrict it to conservation use.
