the Acts of 1998; and finally, to see if the Town will authorize the Conservation Commission
<br /> and the Board of Selectmen to enter into agreements and execute any and all instruments as may
<br /> be necessary on behalf of the Town to effectuate said acquisition and preservation; or take any
<br /> other action relating thereto.

<br /> Explanation: This article would authorize the Board of Selectmen to purchase, on behalf of the
<br /> Conservation Commission, a 7.6 acre parcel on Great May Road, south of Abigail's Brook,
<br /> which is surrounded by existing conservation land owned by the U.S. Fish & Wildlife Service
<br /> and the Town of Mashpee the "Bufflehead Bay" property). The area is in the Mas,hpee National
<br /> Wildlife Refuge, includes bluffs overlooking marshes and abandoned cranberry bogs along
<br /> Abigail's Brook, and is recommended as a top priority acquisition by the Comprehensive Plan
<br /> ,and the Town's open space plan, as well as being a top priority acquisition within the Wildlife
<br /> Refuge. The purchase would be paid for with Land Bank funds. An additional 35.2 acres north
<br /> of Abigail's Brook is proposed to be purchased by the Commonwealth of Massachusetts from
<br /> the same owners, unifying all of the "Bufflehead Bay" parcels originally purchased by the U.S.
<br /> F'ish & Wildlife Service and the Town and virtually completing protection of the southern
<br /> portion of the Wildlife Refuge.

<br /> Motion: I move the Town vote to authorize the Selectmen to acquire, by purchase or otherwise,
<br /> for conservation and passive recreation purposes, all or a portion of that parcel of land identified
<br /> on the 2001 Mashpee Assessors' Maps as Map 115, Block 22, consisting of 7.6 acres, more or
<br /> less, located between Great Hay Road, Wells Road and Abigail's Brook, to be held in the care
<br /> and custody of the Conservation Commission pursuant to Massachusetts General Laws Chapter
<br /> 40, Section 8C for conservation and passive recreation purposes; and further, vote to appropriate
<br /> $208,200 for such purpose, including expenses incidental and related thereto, and to raise such
<br /> appropriation, the Treasurer, with the approval of the Selectmen, be authorized to borrow
<br /> $208,200 under and pursuant to Chapter 44, Sections 7 and 8C and, if applicable, Chapter 40,
<br /> Section 8C of the General laws, or any other enabling authority, and to issue bonds or notes of
<br /> the Town therefor; with said borrowing to be repaid with funds from the Land Bank Fund
<br /> established by the Town under the provisions of Chapter 293 of the Acts of 1998 (An Act
<br /> Relative to the Establishment of the Cape Cod Open Space Land Acquisition Program); and
<br /> further vote to raise and appropriate $1,500 to the Issuance of Debt Account; and further, vote to
<br /> authorize the Board of Selectmen and Conservation Commission to apply for and accept Federal,
<br /> State and/or County grants, including reimbursement under Chapter 4,32A, Section 11 of the
<br /> General Laws, the "Self-help Act", to be applied by the Town toward the financing of this
<br /> acquisibon, and to enter into contracts or agreements with Federal, State and/or County agencies,
<br /> private conservation trusts or other entities or persons in connection with the acquisition of all or
<br /> a portion of such land and its preservation for conservation and passive recreation purposes,
<br /> including conveyance and enforcement of a perpetual conservation restriction on the land in
<br /> accordance with Chapter 184 of the General Laws as required by the provisions of Chapter 293
