If they cannot agree, there shall be three arbitrators: <br /> 'C <br /> the first arbitrator shall be the person named in the notice of intent;the second <br /> arbitrator shall be the person named in the response; and the third arbitrator shall <br /> be appointed by the first two arbitrators within 30 days after the service of the <br /> Response. The Parties further agree that no arbitrator shall be a member or <br /> employee of the Tribe or the Town. If either parry fails to appoint an arbitrator or <br /> fails to appoint a successor arbitrator within 10 days after the incapacity or t <br /> resignation of its previously appointed arbitrator, or if the first and second <br /> 3 arbitrators fail to appoint a third arbitrator within 30 days after the service of the r <br /> I� <br /> response, or fail to appoint a successor third arbitrator within 20 days after the <br /> incapacity or resignation of the previously appointed third arbitrator, then the <br /> arbitrator shall be selected by the Regional Vice-President of the American <br /> Arbitration Association for Massachusetts. <br /> iv. All hearings and other proceedings in the arbitration <br /> shall be held at Mashpee, Massachusetts, unless otherwise agreed by the Parties. <br /> L Meetings of the arbitrator or arbitrators may be in person or, in appropriate <br /> circumstances, by telephone. All decisions of the arbitrator or the arbitration panel <br /> shall be by majority vote, shall be in writing and, together with any dissenting <br /> -ties.
