Explanation: This article would authorize the Board of Selectmen to purchase, on behalf of the <br /> Conservation Commission, two parcels totaling 32.7 acres, more or less, on Turner Road and <br /> adjacent to existing well site lands of the Mashpee Water District and conservation land owned <br /> by the Falmouth Rod & Gun Club. The area is actively being marketed, is in the Mashpee <br /> National Wildlife Refuge and the recharge area of the Water District's Turner Road well and is <br /> recommended for acquisition by the Comprehensive an. The purchase would be paid for with <br /> Land Bank funds. <br /> Motion made by Selectman Marsters. <br /> Moti on: I move the Town hereby authorize the Selectmen to acquire, by purchase or otherwise, <br /> for conservation and passive recreation purposes, all or a portion of those parcels of land <br /> identified on the 1999 Mashpee Assessors' Maps as Map 86, Blocks I and 2, located on "Turner <br /> Road", to be held in the care and custody of the Conservation Commission pursuant to <br /> Massachusetts General Laws Chapter 40, Section 8C; that the Town hereby appropriates the sum <br /> of $3000,000 for such purpose; including expenses incidental and related thereto, and that to <br /> raise this appropriation, the Treasurer, with the approval of the Selectmen, is hereby authorized <br /> to borrow $300,000 under and pursuant to Chapter 44, Section 7(3) or any other enabling <br /> authority, and to issue bonds or notes of the Town therefor; that while any borrowing authorized <br /> hereunder shall constitute a general obligation of the Town, it is expected that all but one dollar <br /> ($,1.0O) of said borrowing shall be repaid with funds from the Land Bank Fund established by the <br /> Town under the provisions of Chapter 293 of the Acts of 1998 (An Act Relative to the <br /> Establishment of the Cape Cod Open Space Land Acquisition Program); that the Town hereby <br /> appropriates, the additional sum of$1,500 from the Land Bank Account to the Issuance of Debt <br /> Account; that the Town hereby authorize the Board of Selectmen and/or Conservation <br /> Commission to apply for and accept Federal, State an County grants, including <br /> reimbursements under Chapter 132A, Section 1.1 of the General Laws, the "Self-Help Act", to be <br /> applied by the Town toward the costs of this purchase, and to enter into contracts or agreements <br /> with Federal, State and/or County Agencies, private conservation trusts or other entities or <br /> persons in connection with the purchase of such land and its preservation for conservation and <br /> passive recreation purposes, including enforcement of conservation restrictions on the land; and <br /> finally, that the Conservation Commission and the Board of Selectmen are each hereby <br /> authorized to enter into agreements and execute any and all instruments as may be necessary on <br /> behalf of the Town to effectuate said acquisition, sale, transfer or preservation. <br /> Motion made to dispense with reading of Article 26 made at 9:07 p.m. <br /> 10 <br /> Motion to dispense with reading of Article 26 passes 9:07 plom. <br /> Motion passes unanimously at 9:16 p.m, <br /> Article 27 <br /> To see if the Town will, vote to authorize the Selectmen to acquire, by purchase or otherwise, for <br /> conservation or recreation purposes, that parcel of land identified on the 1999 Mash pee <br /> Assessors' Maps as Map 36, Block 31, located at 42 Meetinghouse Road; and further, to see if <br /> the Town will vote to raise and appropriate, or transfer from available funds, $55,000 for such <br /> purpose, including expenses incidental and related thereto, and to raise such appropriation, the <br />
