fifty-two (52) weeks prior to the incapacity). In no event shall payment pursuant to Section I I IF <br /> of Chapter 41 exceed, in any calendar year, the limitation on earnings contained in Section 91(b) <br /> of Chapter 32. Payment pursuant to Section I I IF of Chapter 41 shall terminate when a special <br /> police officer reaches the age of sixty-five (65). In the event the age limitation applicable to <br /> regular police officers serving a town is increased from the current sixty-five ( 5) years of age, <br /> the termination of benefits pursuant to Section I I IF of Chapter 41, as provided herein to special <br /> police officers, shall terminate at such a higher age limit, but in no event shall said benefits <br /> extend beyond the age of seventy (70) for any special police officer. Special police officers <br /> appointed under the provisions of this act shall not be subject to the provisions of Section 85H of <br /> Chaptler .3.2, or eligible for any benefits pursuant thereto. <br /> SECTION 8. Appointment as a special police officer shall not entitle any individual appointed <br /> as such to assignment to any detail(s). Special police officers appointed under the provisions of <br /> this act shall not be eligible for unemployment compensation, nor shall the Town be liable for <br /> unemployment benefits, pursuant to the provisions of Chapter 15 1 A of the General Laws, for any <br /> reason, including police detail assignment determinations made by the Town removal of an <br /> individual as a special police officer. <br /> SECTION 9. Retired police officers serving as special police officers pursuant to this act shall <br /> be subject to the limitations on hours worked and on payments to retired town employees set <br /> forth in Section 91A of Chapter 32. <br /> SECTION 10. This act shall take effect upon its passage, or take any other action relating <br /> thereto. <br /> Submitted by the Police Chief <br /> Explanation: Passage of this article will allow the Selectmen to petition the General Court to <br /> enact special legislation to create a Retired Reserve Police Unit within the Mashpee Police <br /> Department consisting of Police Officers who have served in the capacity as a permanent full <br /> time Police Officer in the Town of Mashpee or another municipality of the Commonwealth and <br /> who have retired honorably based on superannuation. The Retired Reserve Police Unit would be <br /> a resource of trained and experienced individuals who may be used to augment the active force <br /> in emergencies, to perform private details, and to accomplish other law enforcement and criminal <br /> investigation operations missions as needed.
