§ L. Severability <br /> If a court determines that any provision of this chapter is invalid or unenforceable, the other provisions <br /> hereof shall not be affected thereby, and shall continue in full force and effect. <br /> or take any other action relating thereto. <br /> Submitted by the Board of Selectmen <br /> Explanation: The purpose of this bylaw is to protect the health, safety, and welfare of both the occupant(s) <br /> of rental housing units and the general public, and to maintain the quality of life in residential <br /> neighborhoods. This bylaw will assist the Town of Mashpee in the enforcement of state and local health <br /> and safety laws and regulations and will provide a method for correcting violations when conditions require <br /> immediate attention, in particular, situations associated with rental tenancy in the Town of Mashpee. <br /> The Board of Selectmen recommends approval of Article 8 by a vote of 4-0 <br /> The Finance Committee recommends approval of Article 8 by a vote of 5-0 <br /> MOTION MADE BY SELECTMAN O'HARA: <br /> Motion: I move the Town vote to approve Article 8 as printed in the warrant with the following Bylaw <br /> text modifications: <br /> In Section A, add",the provisions of G.L.c. 64G, §14,and any other enabling authority"after"Home Rule <br /> Authority"in the first sentence. <br /> In Section B.2 (Dwelling), substitute "any facility licensed under any state housing or local housing laws <br /> or bylaws, including affordable housing facilities" for "any licensed facility and/or affordable housing <br /> facilities" at the end of that sentence; <br /> Delete Section B.3 (Licensed Facility); <br /> In Section B.7, delete the existing definition of"Rental Property" and substitute the following language <br /> therefor: "Rental Property-an owner-occupied,tenant-occupied,or non-owner occupied property including, <br /> but not limited to, an apartment, house, cottage, condominium, or furnished accommodation that is not a <br /> hotel, motel, lodging house, or bed and breakfast establishment where 1) at least one room or unit is rented <br /> to an occupant or sub-occupant for a period of at one night but not but not more than 31 consecutive calendar <br /> days; and 2) all accommodations are reserved in advance."; <br /> In Section CA.IV, substitute the clause"within a reasonable period of time, as defined by Board of Health <br /> regulation." for "within two hours for emergencies and twelve (12) hours for non-emergencies of being <br /> called"; <br /> In Section D.1,fifth sentence, substitute the clause"within a reasonable period of time, as defined by Board <br /> of Health regulation." for "within two (2) hours or twelve (12) hours for non-emergency requests for <br /> assistance of any such notification or request"; <br /> 20 <br />
