Massachusetts General Laws Chapter 40, Section 8C; and further, to see if the Town will
<br /> vote to raise and appropriate, or transfer from available funds, $410,574 for such purpose,
<br /> including expenses incidental and related thereto, and to raise such appropriation, the
<br /> Treasurer, with the approval of the Selectmen, be authorized to borrow $410,574 or any
<br /> other sum under and pursuant to Chapter 44, Sections 7 and 8C and, if applicable, Chapter
<br /> 40, section 8C of the General laws, or any other enabling authority, and to issue bonds or
<br /> notes of the Town therefor and to designate said land as an open space land acquisition
<br /> pursuant to the Cape Cod Open Space Land Acquisition Program established by Chapter
<br /> 293 of the Acts of 1998 so as to permit said borrowing to be repaid with funds from the
<br /> land bank fund established by the Town under the provisions of Chapter 293, and further,
<br /> to see if the Town will vote to raise and appropriate or transfer from available funds
<br /> $2500 to the Issuance of Debt Account; and further, to see if the Town will authorize the
<br /> Board of Selectmen and/ or Conservation Commission, with the approval of the Board of
<br /> Selectmen, to apply for and accept Federal, State and / or County grants, including
<br /> reimbursement under Chapter 132A, Section 11 of the General Laws, the "Self-Help Act",
<br /> to be applied by the Town toward the financing of this purchase, and to enter into
<br /> contracts or agreements with Federal, State and/or County agencies, private conservation
<br /> trusts or other entities or persons in connection with the purchase of such land and its
<br /> preservation for conservation purposes, including enforcement of conservation restrictions
<br /> on the land; and finally, to see if the Town will authorize the Conservation Commission
<br /> and the Board of Selectmen to enter into agreements and execute any and all instruments
<br /> as may be necessary on behalf of the Town to effectuate said acquisition, sale, transfer, or
<br /> preservation, or take any other action relating thereto.

<br /> Explanation: This article would authorize the Board of Selectmen to purchase, on behalf
<br /> of the Conservation Commission, a number of parcels totaling 35.58 acres on the west
<br /> side of the Santuit River. The parcels are partially interspersed with existing Town lands
<br /> and land of others. Recent studies by the Public Archaeology Lab indicate that the
<br /> properties contain extensive archaeological deposits dating back 5000 years. The area is
<br /> under threat of development for residences or a golf course, is in the recharge area of
<br /> Shoestring Bay, and is recommended as a priority acquisition by the Comprehensive Plan.

<br /> Motion: I move that the Selectmen be hereby authorized to acquire, by purchase or
<br /> otherwise, for conservation purposes, all or a portion of those parcels of land identified on
<br /> the 1998 Mashpee Assessors' Maps as Map 70, Blocks 24, 25, 26, 27, 28, 29, 30, 31, 32,
<br /> 33, 34, 35, 36 and 37, Map 70, Blocks 8, 10, 12, 14, 20, 22, 98, 102, 107, 108, 111, 112,
<br /> 116, 199, 123, 126, 130, 137, 138 and 140 and Map 77, Blocks 1, 4, 9, 11 and 13, located
<br /> between the Santuit River, Maushop Stables, the Willowbend Development, and Cotuit
<br /> Bay Condominiums off Quinaquisset Avenue, to be held in the care and custody of the
<br /> Conservation Commission pursuant to Massachusetts General Laws Chapter 40, Section
<br /> 8C; and further, that the Town appropriate the sum of $434,000 for such purpose,
<br /> including expenses incidental and related thereto, and that to raise this appropriation, the
<br /> Treasurer, with the approval of the Selectmen, is hereby authorized to borrow $434,000
