funds $400 to the Issuance of Debt Account; and further, to see if the Town will authorize
<br /> the Board of Selectmen and/or Conservation Commission, with the approval of the Board
<br /> of Selectmen, to apply for and accept Federal, State and/or County grants, including
<br /> reimbursement under Chapter 132A, Section 11 of the General Laws, the "Self-Help Act",
<br /> to be applied by the Town toward the financing of this purchase, and to enter into
<br /> contracts or agreements with Federal, State and/or County agencies, private conservation
<br /> trusts or other entities or persons in connection with the purchase of such land and its
<br /> preservation for conservation purposes; and finally, to see if the Town will authorize the
<br /> Conservation Commission and the Board of Selectmen to enter into agreements and
<br /> execute any and all instruments as may be necessary on behalf of the Town to effectuate
<br /> said acquisition, or take any other action relating thereto.

<br /> Explanation: This article would authorize the Board of Selectmen to purchase, on behalf
<br /> of the Conservation Commission, a 3.5 acre parcel of land having approximately 700 feet
<br /> of shoreline on the east side of Santuit Pond. The area has been recommended for
<br /> conservation protection in the Town's approved open space plan since 1983.
<br /> Motion made by Selectman Frye.
<br /> Motion: I move that the Selectmen be hereby authorized to acquire, by purchase or
<br /> otherwise, for conservation purposes, a certain parcel of land shown on a"Plan of Land in
<br /> Mashpee, Massachusetts Belonging to Herbert & Florence Bickerstaffe" dated December
<br /> 2, 1963 by Nelson Bearse — Richard Law, Surveyors, Centerville, Massachusetts,
<br /> containing 3.77 acres, more or less, being that land shown on the 1998 Mashpee
<br /> Assessors' Maps as Map 30, Block 117, located between "Chopchague Road" and the
<br /> east shore of Santuit Pond, to be held in the care and custody of the Conservation
<br /> Commission pursuant to Massachusetts General Laws Chapter 40, Section 8C; and further
<br /> that the sum of $65,000 is hereby appropriated for such purpose, including expenses
<br /> incidental and related thereto, and that to raise this appropriation, the Treasurer, with the
<br /> approval of the Selectmen, is authorized to borrow $65,000 under and pursuant to
<br /> Chapter 44, Sections 7 and 8 and, if applicable, Chapter 40, Section 8C of the General
<br /> Laws, or any other enabling authority, and to issue bonds or notes of the Town therefor;
<br /> and to designate said land as an open space land acquisition pursuant to the Cape Cod
<br /> Open Space Land Acquisition Program established by Chapter 293 of the Massachusetts
<br /> Acts of 1998 so as to permit said borrowing to be repaid with funds from the land bank
<br /> fund established by the Town under the provision of Chapter 293 of the Massachusetts
<br /> Acts of 1998, which borrowing shall nevertheless constitute a general obligation of the
<br /> Town, and further, that the sum of$400 is hereby appropriated from available funds to the
<br /> Issuance of Debt account; and further, that the Board of Selectmen and/or Conservation
<br /> Commission, with the approval of the Board of Selectmen are each hereby authorized to
<br /> apply for and accept Federal, State and/or County grants, including reimbursement under
