being that land shown on the 1998 Mashpee Assessors' Maps as Map 114, Block 8, <br /> located between Monomoscoy Road West and the east shore of Hamblin's Pond; and that <br /> the Town appropriate the sum of$33,900 for such purpose, including expenses incidental <br /> and related thereto, and that to raise this appropriation, the Treasurer, with the approval <br /> of the Selectmen, is hereby authorized to borrow $33,900 under and pursuant to Chapter <br /> 44, Sections 7 and 8 and, if applicable, Chapter 40, Section 8C of the General Laws, or <br /> any other enabling authority, and to issue bonds or notes of the Town therefor, and to <br /> designate said land as an open space land acquisition pursuant to the Cape Cod Open <br /> Space Land Acquisition Program established by Chapter 293 of the Massachusetts Acts of <br /> 1998 so as to permit said borrowing to be repaid with funds from the land bank fund <br /> established by the Town under the provisions of Chapter 293 of the Massachusetts Acts of <br /> 1998, which borrowing shall nevertheless constitute a general obligation of the Town, and <br /> further, that the Board of Selectmen is hereby authorized to enter into contracts or <br /> agreements with Federal, State and/or County agencies, private conservation trusts or <br /> other entities or persons in connection with the purchase of such land, including <br /> enforcement of deed restrictions on the land as required by Chapter 293 of the <br /> Massachusetts Acts of 1998; and finally, that the Board of Selectmen is hereby authorized <br /> to enter into agreements and execute any and all instruments as may be necessary on <br /> behalf of the Town to effectuate said acquisition. <br /> Motion defeated at 10:49 p.m. <br /> ARTICLE 26 To see if the Town will vote to authorize the Board of Selectmen to grant <br /> a temporary two year easement to the United States of America over that parcel of <br /> conservation land known as the Quashnet Cranberry Bog, comprised of 27.22 acres more <br /> or less and shown on Mashpee Assessors Map 43, Block 2, Lot 0, in the form as approved <br /> by the Board of Selectmen on September 28, 1998 in the document entitled Department of <br /> the Army Offer to Sell Easement and accepted by the United States of America on <br /> September 29, 1998, and further to authorize the Board of Selectmen to petition the <br /> General Court for special legislation which may be necessary authorize the granting of said <br /> temporary easement, or take any other action relating thereto. <br /> Submitted by the Conservation Commission <br /> and Board of Selectmen <br /> Explanation: This article is necessary to approve the temporary restrictive easement <br /> approved by the Board of Selectmen which provides that the Town will not cultivate <br /> cranberries for a period of two years on the Quashnet Cranberry Bog where groundwater <br /> contamination emanating from the Massachusetts Military Reservation has been found, in <br /> exchange for compensation to be paid by the United States government to the Town for <br /> the loss of these crops. <br /> Motion made by Selectman Leveille. <br /> Motion: I move the Town authorize the Board of Selectmen to grant a temporary two <br /> year easement to the United States of America over that parcel of conservation land <br /> known as the Quashnet Cranberry Bog, comprised of 27.22 acres more or less and shown <br />
