Motion made by Ken Marsters. <br /> Motion: I move Article 26 be approved as printed in the warrant except to replace the phrase <br /> "Subsection B.(15)"with"Subsection B.(16)" and replace "(15)"with"(16)" in said Subsection <br /> And to delete the phrase, "or take any other action relating thereto." <br /> Planning Board voted at the Public Hearing held on August 19, 1998 3 to 1 to approve <br /> Article 26. <br /> Motion passes unanimously at 7:40pm. <br /> Article 27 <br /> To see if the Town will vote to amend the zoning bylaw by amending Subsection 174-47.C.(I) as <br /> follows: <br /> In the first sentence, replace the phrase "and shall be filed at a regular meeting of the Board" with <br /> the phrase "and shall be filed with the Town Clerk". <br /> Replace the last sentence with the following: <br /> "After submission of the required materials to the Town Clerk, the applicant shall forthwith <br /> deliver to the Planning Board a copy of said materials, including the date and time of filing <br /> certified by the Town Clerk." <br /> or take any other action relating thereto. <br /> Submitted by Planning Board <br /> Explanation: The filing procedure for cluster subdivision special permits contained in the zoning <br /> bylaw is currently inconsistent with the requirements of Massachusetts General Laws, Chapter <br /> 40A, Section 9, which requires that all special permit applications be filed first with the Town <br /> Clerk and then transmitted to the special permit granting authority. (Our bylaw has the procedure <br /> reversed.) This article would correct that inconsistency. <br /> Motion made by Curtis Frye. <br /> Motion: I move Article 27 be approved as printed in the warrant with the exception of the <br /> phrase, "or take any other action related thereto." <br /> Planning Board voted at the Public Hearing held on August 19, 1998 4 to 0 for approval on <br /> Article 27. <br /> Motion passes unanimously at 7:42pm. <br /> Page 23 of 63 <br />
