AUTHO IT <br /> This bylaw prescribes certain powers and duties of the <br /> Highway Surveyor. He is authorized to issue permits f or <br /> � y <br /> work to be performed upon any Town Highways or section <br /> thereof. <br /> 10 <br /> In this connection attention is directed to the "Town of <br /> 1 fashpee bylaws" effecting Town Highways which provides <br /> r as follows <br /> "Digging up 'down Highways; Bond; . Permit, No 'Town <br /> e Highway shall be dug up, or opening made therein for any <br /> purpose, nor shall any material be dumped or placed thereon <br />- or removed or-construction or structure placed thereon or re- <br /> e moved therefrom or changed without the written permit. of <br /> e the Highway Surveyor, and the work shall be done under its <br /> n supervision and to its satisfaction, and the entire expense of <br /> replacing and resurfacing the highway at the same level and <br /> in as good condition as before., with material equal in specifi- <br /> cations- to those removed, shall be paid by the persons to <br /> whom the permit was given or by whom the work was done. <br /> The Department may require a band to guarantee the faith-- <br /> e ful and satisfactory performance of the work and payment <br /> ay <br /> for any damage to town highways and facilities caused :by <br /> or resulting from the operations authorized by such permit. <br /> The amount of said bond shall be not less than one thousand <br /> be - <br /> dollars and not more than fifty thousand dollars. Except as <br />�m <br /> provided herein any person who digs up or makes an opening <br /> a in a town highway without a permit or violates any other <br /> yee s 1 provisions of the section shall be punished by a fine. of not <br /> n <br /> y more than fifty dollars for the first offense and not less than <br /> at' fifty dollars nor more than one hundred dollars for any.sub- <br /> subsequent offense." <br /> Lp- 1 12.
