5 <br /> Board of Selectmen <br /> Minutes <br /> November 2, 2020 <br /> APPOINTMENTS & HEARINGS <br /> Public Hearing: (Continued from August 24, 2020): <br /> Adoption of a Local Licensing Regulation per G L c 138 $23 and Board of Selectmen Policy#068 Alcoholic <br /> Beverages Licenses (Section III—Package Store All Alcohol) Banning the Sale of Alcohol Nips (50 mil) (50 <br /> milliliter(ml) container) and, Further Banning the Sale of Alcohol Nips in Containers of up to 100 ml in size, <br /> as a Condition of any New Renewed and/or Transferred License for Establishments Licensed Pursuant to G.L. <br /> c 138 §15 Based on Considerations of Public Health, Welfare and Safety: (continued) <br /> Bryan Anderson owner of Andy's Market stated that he believes a vote of cancelling the sale of alcohol nips <br /> should be a vote of the Town and not a group of individuals making the decision. Mr. Anderson recommended <br /> the Board consider the decision at town meeting. Mr. Anderson also indicated the banning of the sale of <br /> alcohol nips will drastically affect many small businesses. A ban in two or four months is considered sudden. <br /> Mr. Anderson informed the Board the industry has met,but it has been very difficult to get all parties together <br /> during the pandemic to work towards a solution as many business owners are working 65 hours per week. <br /> Dena Rymsha spoke again on this matter stating that those who leave a liquor store are rarely driving under the <br /> influence. Ms. Rymsha asked why is liquor industry is the only type of business banning together to clean-up <br /> the town. <br /> Robert Million, Director of the Massachusetts Package Stores Association(MPSA) indicated the entire <br /> industry is working to address this issue across the state. The real issue is littering, it is not just alcohol nip <br /> bottles. As a community of retailers we are trying to solve the issue of litter. Mr. Million respectfully <br /> requested the Select Board grant additional time to solve the litter problem by having clean-ups and working <br /> together to get this done. <br /> In closing there was a brief comment in support of additional waste receptors. But when all is said and done, <br /> nip drinkers may continue to throw their emptied container out the window. <br /> Being no further comment, the Board of Selectmen acted as follows; <br /> Motion made by Selectman Gottlieb to close the Public Hearing. <br /> Motion seconded by Selectman Sherman. <br /> VOTE: Unanimous. 5-0. <br /> Roll Call Vote: <br /> Selectman Cotton,yes Selectman O'Hara,yes Selectman Sherman,yes <br /> Selectman Gottlieb,yes Selectman Weeden,yes Opposed, none <br /> The Board continued their discussion. It was noted that communication was received from the Mashpee <br /> Chamber of Commerce dated October 20, 2020 stating that no member of the business community has <br /> contacted the Chamber with regards to the bottle issue. The Chamber in their memorandum stated it is their <br /> decision to remain neutral at this time and for the Select Board to continue to advise on this matter. <br />
