4 <br /> Board of Selectmen <br /> Minutes <br /> May 24, 2021 <br /> Public Hearing: Road Taking — Chestnut Street, Cedar Street, Devon Street, Ash Street, Hawthorne Street, Gina's <br /> Way-, (continued) <br /> Being no further comment the Board motioned as follows; <br /> Motion made by Selectman Sherman to close the Public Hearing. <br /> Motion seconded by Selectman O'Hara. <br /> VOTE: Unanimous. 5-0. <br /> Roll Call Vote: <br /> Selectman Cotton, yes Selectman O'Hara,yes Selectman Sherman, yes <br /> Selectman Gottlieb,yes Selectman Weeden, yes Opposed, none <br /> If the applicants desire to move forward with the road taking necessary paperwork for the second petition can be <br /> obtained through the Office of the Town Manager/Board of Selectmen. <br /> Public Hearing: Road Taking—Cove Road: <br /> The Board of Selectmen opened the Public Hearing to discuss the private to public road conversion of Cove Road <br /> as prepared by Cape&Islands Engineering dated March 5, 2021. Copies of the plan are available in the Office of <br /> the Town Manager/Board of Selectmen. The Hearing notice was read into the record to conform to posting <br /> requirements. Catherine Laurent,Director of Public Works was present to discuss the private to public road <br /> conversion of the referenced streets. <br /> The estimated betterment cost is $229,3 98.75, a cost of$19,116,57 to be borne by the (12)property owners. <br /> If residents plan to move forward with the road conversion a second petition signed by at least 50% plus 1 of the <br /> affected property owners must be received by July 12, 2021 in order to be placed on the October Town Meeting <br /> warrant or by February 14, 2022 to be placed on the May Town Meeting warrant. <br /> It was noted this road taking was petitioned by at least 50%plus I of the affected property owners. <br /> Wililiam Petrone a resident of 75 Cove Road stated the road type in his opinion is public. The road as it currently <br /> exists is paved and ends at a cul de sac. A portion of this road is unpaved. Why would he want to be involved in <br /> fixing the unpaved portion of the road to allow the public to drive past his home? <br /> Ms. Laurent responded by stating the road in its entirety is private. To bring the road to Town standards it is <br /> necessary to prepare the road, conduct drainage requirements and widen as necessary for safety response. The <br /> petition requires a ininimurn. of 50% plus I of the affected property owners to modify the project and to move the <br /> project forward to Town Meeting. <br /> For clarification purposes it was disclosed the unpaved section of Cove Road lies within the Town of Sandwich. <br /> Stephanie Rhea of 59 Cove Road noted the former owner of the property is listed on the plan. Ms. Rhea stated the <br /> project as outlined would disrupt a portion of her property that has been improved by landscape, The Public <br /> Works Director indicated the section of the road in this area is a wider width. With the exception of drainage <br /> within the right of way, work should be minimal. Generally, plant material is not replaced by the Town, but can <br /> be moved and replanted if necessary. <br />
