Proposed demolition and RDA <br /> reconstruction of existing retaining walls and installation of native plantings. <br /> Homeowners John and Helen Pentikis presented plans. <br /> Agent gave a brief background as to why the work appears to have already been started. <br /> A stop work order was issued because no permits were obtained. As far as the retaining <br /> wall, the repairs are pretty straightforward. The mitigation plants need to have at least 3 <br /> different varieties of native species. He stated that when the use of the town easement to <br /> enter the property was questioned, the contractor said he was given permission by the <br /> homeowners. The Agent explained that the easement is Town owned property and that <br /> permission should have been requested. The contractor and the homeowners will be <br /> responsible for any damage incurred by the issue of an enforcement order. Helen Pentikis <br /> stated that she did not grant permission to the contractor and was unaware that he claimed <br /> such a discussion occurred. She assumed being an experienced local contractor, he knew <br /> of any regulations regarding access to the property. <br /> Mr. Sweet suggested that they put a well around a tree that was in danger from back fill, <br /> John Pentikis said they would do that, probably this week. <br /> Motion made by Mr. Sweet for a negative determination. <br /> Motion seconded by Mr.Dalton. <br /> Vote: 6-0-0 <br /> Roll Call Vote: <br /> Mr. Smith, yes <br /> Mr. Sweet, yes <br /> Mr. O'Neill, yes <br /> Mr. Colombo, yes <br /> Mr. Weeden, yes <br /> Mr. Dalton, yes <br /> In favor, 6; Opposed, 0; Abstentions, 0 <br />
