down the bank, it's a pretty thickly vegetative bank. No impact to inland bank. No other
comments, recommend a close and issue. Mr. Sweet asked about the dwelling on the edge of
the bank, any changes? Mr. Ball said no, it stays as it is. Mr. Sweet asked about septic. Mr.
Ball said there is some additional piping. Agent said Board of Health said a septic inspection
is required, if the system passes we will leave it there, if it fails then will be designed in
accordance with Title V.
Motion: Mr. Smith moved to close and issue with the condition of the letter from the
Board of Health and approval from National Heritage. Mr. Dalton seconded.
Vote: 5-0 unanimous
6:16 Jeanne Marie Warren Adler, Trustee, 48 Clover Lane. Proposed septic system upgrade. RDA
Bob Banks from Engineering Works presented plans. There's a Board of Health meeting on
12/19/19. Agent said it's pretty straightforward. Not much to add, just make the homeowners
aware of pitch pine-nothing to do with this proposal, but the branch is hanging on by a thread.
It could do some serious damage.
Motion: Mr. Smith moved for negative determination. Mr. Dalton seconded.
Vote: 6-0 unanimous
3
6:18 Charles M. Talanian, et al Trustees, 29 Ockway Bay Road. Septic system upgrade. RDA
Bob Banks from Engineering Works presented plans for an after the fact RDA. Agent said
Board of Health brought this to his attention a few months back. What they did to
accommodate the work in the absence of permitting was issue an emergency certification. All
went very smoothly, no impact to resource area, all contained in the driveway layout and
restored to previous condition. Agent recommends a negative determination.
Motion: Mr. McKay moved for negative determination. Mr. Dalton seconded.
Vote: 5-0 unanimous
6:21 Roger Schiffman & Patricia Donnelly, 4 Mute Swan Circle. Proposed construction of NOI
single-family dwelling, attached garage, in-ground swimming pool, pool house, patio, fencing,
hardscaping, landscaping and access stairs/pathway to new pier, ramp, float and piles
structure. Continued from 11114 due to lack of quorum— Commissioner rectised himself.
Thomas O'Neil recused himself, Steven cook will be the alternate Commissioner. Matt Costa
from Cape &Islands Engineering presented plans. Ms. Cadoret asked about the depth of the
pool. Mr. Costa said 8ft deep, no ground water issues. Ms. Cadoret asked if the proposed patio
is pervious. Mr. Costa said no. Agent said the section of boardwalk going over the salt march,
usually has 3/4"basing, is that a possibility? Mr. Costa said that's not a problem. Agent said
there's not much else to add. There is an abutter here tonight. Mr. Sweet asked why the patio is
not impervious, what will you do to handle runoff water? Mr. Costa said runoff to edge of
vegetation. Agent said it's a pretty thickly vegetative area. Mr. Costa said they have no
concerns.Mr. Bregman asked about the size of the house. Mr. Costa said 5,451 sq ft including
the pool. He didn't have an exact number for the house. Mr. Cook asked about new plantings.
Ms. Cadoret said there are 4 species listed on the plan.
Public Comment: Philip Lavin, an abutting neighbor had some concerns about the pitch of the
roof, water runoff, the spillway and erosion. He planted trees for privacy and to protect from
erosion. The trees are 50ft tall and the roots systems go down about 101 The Rhododendrons
in between have root systems that go down about 31 He's done a pretty good job of securing
the land against erosion and spill over. This was done at the request of the previous
homeowner. At this point, he's trying to his best to prevent erosion spillover. Mr. Smith said
he understands the concern but believes we're looking at a series of drywells that would
alleviate some of the problems. Mr. Levin said when it rains 3 inches you can see the water, in
his experience it will take a lot of drywells to prevent the erosion that he thinks he is trying to
prevent. Nft. McKay asked where the spillway is collecting water from. Mr. Levin said the
water comes from two sources. First, it comes from the trees, the water will be coming down
that side over the lawn and there's a stone wall that helps to buffer from the water, but that
grass we're constantly trying to battle against the water. It just comes down in to the spillway
but we can't get anything to grow there. With the additional pitch of the roof, that's going to
double the pressure in that area. Ms. Cadoret asked if the Arborvitae will prevent erosion once
