Brennan and Patricia A. <br /> Brennan requesting a Special Permit under §174-17.1 of the Zoning Bylaws to allow for a <br /> raze and replace of a non-conforming three bedroom single family residential structure <br /> with a new code compliant three bedroom residence, on property located in an R-3 Zoning <br /> District, at 126 Summersea Road, Map 105 Parcel 54, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on May 14, 2021 and May 21, 2021. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, June <br /> 9, 2021 at which time the following members of the Board of Appeals were present and <br /> acting throughout; Vice Chairman, William Blaisdell, Board Members, Ron Bonvie, Scott <br /> Goldstein,Norman J. Gould, and Associate Member Sharon Sangeleer. <br /> Attorney Kevin Kirrane represented the raze and replace project. Also present was <br /> Architect,Denise Bonoli. Mr. Kirrane provided the Board with his written presentation, an <br /> existing and proposed site plan of the lot, and photographs of the neighboring homes. The <br /> lot itself is a non-conforming lot given its size and frontage. The current building that exists <br /> on the lot is also non-conforming as shown on the site plan. <br /> The current front dimension from Summersea Road is 22.5 ft., the existing is 22.3 ft., and <br /> the required setback is 40 ft. from the front. The northerly lot line is improving from 10.3 <br /> ft. to 14.8 ft., and the southerly lot line is 8.6 ft. to 11.5 ft., and also improving from 28 ft. <br /> to 33 ft. from the wetlands. <br /> 1 <br />
