3 <br /> Board of Selectmen <br /> Minutes <br /> June 7, 2021 <br /> ADDITIONAL TOPICS <br /> (This space is reserved for topics that the Chairman did not reasonably anticipate would be discussed) <br /> Mashpee Commons Expansion Project—Three-Party Development Agreement/Proposed Expansion; <br /> (continued) <br /> Selectman David W. Weeden offered comments with respect to the Town's Zoning Bylaw specifically <br /> under Development Agreements as outlined under §174-27.1. The purpose and intent of the bylaw enables <br /> the Town to enter into Development Agreements consistent with the provisions of the Cape Cod <br /> Commission Act and Chapter D,the code of the Cape Cod Commission regulations of general application. <br /> The Act provides that such Development Agreements may proceed as long as the Town's Local <br /> Comprehensive Plan has been certified by the Cape Cod Commission as consistent with the Regional Policy <br /> Plan. The Local Comprehensive Plan(LCP)last updated in 1998 is under revision. Selectman Weeden <br /> asked is the Plan consistent with the 2019 Regional Policy Plan? <br /> Under the bylaw, negotiations of the elements of a Development Agreement between"Participating Parties" <br /> and a Qualified Applicant shall be led by the Planning Board or its designee, and may include <br /> representatives from other municipal boards, departments and commissions where joint participation would <br /> assist the negotiation process. <br /> Selectman David W. Weeden indicated he is concerned with the process as it relates to the 400-page <br /> document and timeline as being rushed in an effort to move forward to obtain passage at Town Meeting. <br /> Selectman Weeden urged the Board to commit funds for independent assessments to include environmental, <br /> financial impacts,traffic studies and archaeological review. It was also recommended the Board identify <br /> applicable boards, departments and/or commissions with relevant knowledge and skills to contribute to <br /> discussions and negotiations. <br /> Selectman Weeden stated the process is unfair to our civil servants who are part-time volunteers when the <br /> Cape Cod Commission and Mashpee Commons have teams of attorneys and other skilled personnel to offer <br /> representation. It was recommended the Board of Selectmen make a commitment to support their Planning <br /> Board. <br /> As discussion continued it was agreed the Board of Selectmen would arrange to meet with the Planning <br /> Board to determine how the Town will meet this challenge amongst the two boards. Town Manager <br /> Rodney C. Collins indicated if he is so directed, funds would be made available for consulting purposes <br /> with resources to be provided as necessary. <br /> In lieu of the October warrant,it was recommended the Board consider a Special Town Meeting in 2022. <br /> Motion made by Selectman Gottlieb to set a Special Town Meeting date after the first of January <br /> 2022. The motion was amended to hold a Special Town Meeting in March of 2022 on articles <br /> associated to this project, and request the Planning Board attend a joint meeting with the Board of <br /> Selectmen to discuss the process issues as conveyed by Selectman Weeden. <br /> Motion seconded by Selectman O'Hara. <br /> VOTE: Unanimous. 5-0. <br /> Roll Call Vote: <br /> Selectman Sherman, yes Selectman Weeden, yes Selectman Gottlieb,yes <br /> Selectman Cotton,yes Selectman O'Hara, yes Opposed, none <br />
