AMENDMENT NO. 4 <br /> TO AGREEMENT BETWEEN <br /> TOWN OF MASHPEE, MASSACHUSETTS <br /> AND <br /> GHD INC. <br /> WHEREAS GHD (ENGINEER) and the Town of Mashpee, MA by its Sewer Commission (OWNER/OWNER) <br /> entered into an Agreement for Site 4 Wastewater Treatment Facility Design Services dated August 2018; and <br /> WHEREAS, TOWN and GHD executed Amendment No. 1 for the development of the Preliminary Engineering <br /> Report; and <br /> WHEREAS, TOWN and GHD executed Amendment No. 2 for Phase 1 Mashpee Resource Recovery Facility <br /> (WRRF) and Phase 1 Collection System Final Design; and <br /> WHEREAS, TOWN is currently reviewing the proposed Amendment No. 3 for the Route 151 Sewer(Phase 2 <br /> Infrastructure on Route 151 between Old Barnstable Road and Mashpee Town line); and <br /> WHEREAS, TOWN desires to proceed with the Construction of the first phase of the Wastewater Nutrient <br /> Management Plan (WNMP) improvements. These improvements are planned to be bid as three separate <br /> construction projects as follows; Contract 1 (Mashpee Water Resource Recovery Facility-WRRF), Contract 2 <br /> (Route 28 and North Collection System), and Contract 3(South Collection System and Pumping Stations). <br /> NOW, THEREFORE, GHD and TOWN agree amend the Agreement as follows. <br /> PART 1. BASIC SERVICES <br /> The scope items described below will be performed for each of the three construction contracts identified <br /> above, unless otherwise noted. <br /> 1.01 Bidding Phase <br /> A. Prequalification(Contract 1 Only): During the final design phase as identified in Amendment No. 2 to this <br /> Agreement, ENGINEER shall facilitate and participate in the Prequalification of General Contractors and <br /> Filed-SubBid Subcontractors for Contract 1. Prequalification shall be done in accordance with <br /> Massachusetts General Law (M.G.L). c. 149, 44D '/2 and 44D %, and 810 Code of Massachusetts <br /> Regulation (CMR)9.00 and 10.00. Services shall include the following: <br /> 1. Participate in the Prequalification Evaluation Committee consisting of two representatives of <br /> ENGINEER and two representatives of the OWNER. Three meetings are planned; one to kick-off the <br /> process; one to receive the prequalification documents and finalize the evaluation process; and one to <br /> review the evaluations. <br /> 2. Prepare the Request for Qualifications / Statement of Qualifications (RFQ/SOQ) for the General <br /> Contractors. <br /> 3. Prepare the RFQ/SOQ for the Filed-SubBid Subcontractors. <br /> 4. Assist the OWNER in advertising the two RFQ/SOQ in the Central Registry,COMMBUYS,and the local <br /> newspaper. <br />
