If OWNER engages in negotiations with bidders or proposers, assist OWNER with respect to technical <br /> and engineering issues that arise during the negotiations. <br /> 11. Perform or provide the following other Bidding or Negotiating Phase tasks or deliverables: None. <br /> C. The Bidding or Negotiating Phase will be considered complete upon commencement of the Construction <br /> Phase or upon cessation of negotiations with prospective contractors. <br /> 1.02 Construction Phase <br /> A. Upon successful completion of the Bidding Phase, and upon written authorization from OWNER, <br /> ENGINEER shall: <br /> 1. General Administration of Construction Contract. Consult with OWNER and act as Client's <br /> representative as provided in the Construction Contract.:The extent and limitations of the duties, <br /> responsibilities,and authority of ENGINEER shall be as assigned:in the Construction Contract and shall <br /> not be modified except as ENGINEER may otherwise agree in writing. ENGINEER shall not be required <br /> to furnish or perform services contrary to ENIGINEER's responsibilities as a licensed professional. All <br /> of OWNER's instructions to Contractor will be issued through ENGINEER, which shall have authority <br /> to act on behalf of OWNER in dealings with Contractor to,the extent provided in this Agreement and <br /> the Construction Contract except as otherwise provided in writing. <br /> 2. Resident Project Representative;(RPR): Provide the.services of an RPRs at the Site to assist the <br /> ENGINEER and to provide more,extensive observation of Contractor's work. Duties, responsibilities, <br /> and authority of the RPR are as set forth in Exhibit D(attached to this Amendment No.4).The furnishing <br /> of such RPR's services will not limit,extend,or modify;ENGINEER's responsibilities or authority except <br /> as expressly set forth`in Exhibit D.The following is!the budget for resident representatives: <br /> a. Contract 1:;Part-time and Full-time RPR — It is anticipated that full-time RPR services will be <br /> needed for approximately nineteen (19)'months of the project of the estimated 26-month project, <br /> and part-time RPR services will be provided for approximately five (5) months. <br /> b. Contracts 2 and 3 Full time RPRs is anticipated that full-time RPR services will be needed <br /> for approximately seventeen (17) months over the estimated 26-month duration of the projects. <br /> This budget is based on no linear work being performed during three summer months each year. <br /> U;p to four(4) RPRs are anticipated to be on-site at any time. RPR services are not expected to <br /> 11 <br /> exceed, 40 hours per',' eek per RPR. If required, RPR services above 40 hours per week per <br /> RPR shall be paid at 1.5 times the hourly rate. <br /> 3. Construction 'Permit Notifications: Provide assistance with notifications associated with existing <br /> construction permits';',Prepare and submit reports and filings required by these permits, exclusive of <br /> those required to be`completed and submitted by the Contractor. This includes but is not limited to: <br /> a. Massachusetts Department of Transportation for Contract 3. <br /> 4. Pre-Construction Conference: Facilitate and participate in a pre-construction conference prior to <br /> commencement of Work at the Site. <br /> 5.
