Final Notice of Acceptability of the Work: Conduct a final visit to the Project to determine if the Work is <br /> complete and acceptable so that ENGINEER may recommend, in writing,final payment to Contractor. <br /> Accompanying the recommendation for final payment, ENGINEER shall also provide a notice to <br /> OWNER and Contractor that the Work is acceptable to the best of ENGINEER's knowledge, <br /> information, and belief, and based on the extent of the services provided by ENGINEER under this <br /> Amendment No.4. <br /> 26. Standards for Certain Construction-Phase Decisions: ENGINEER will render decisions regarding the <br /> requirements of the Construction Contract Documents, and judge the acceptability of the Work, <br /> pursuant to the specific procedures set forth in the Construction Contract for initial interpretations, <br /> Change Proposals, and acceptance of the Work.'' In rendering such decisions and judgments, <br /> ENGINEER will not show partiality to OWNER 'or Contractor, and will not be liable to OWNER, <br /> Contractor, or others in connection with any proceedings, interpretations, decisions, or judgments <br /> conducted or rendered in good faith. <br /> B. Duration of Construction Phase: <br /> 1. The Construction Phase will commence with the date of Notice to Proceed of the first Construction <br /> Contract for the Project or any,,part thereof and will terminate upon written recommendation by <br /> ENGINEER for final payment to Contractors. The combined contract schedule is 790 days. The <br /> contract duration for each individual contract as defined by each Construction Contract is as follows: <br /> a. Contract 1:Mashpee WWRF—790 days (26 months) <br /> b. Contract 2:Route 28 and North Collection System 670 days (22 months) <br /> c, Contract 3: South Collection System and Pumping Stations—790 days(26 months) <br /> 1.03 Post-Construction Phase <br /> A. During the Post-Construction Phase, ENGINEER shall: <br /> 1`. Together with OWNER, visit ;the Project'to observe any apparent defects in the Work, make <br /> recommendations as'oxeplacement or correction of defective Work, if any,or the need to repair of any <br /> damage, to the Site or adjacent areas, and assist OWNER in consultations and discussions with <br /> Contractor concerning correction of any such defective Work and any needed repairs. <br /> 2. Together with OWNER,visit'the Project within one month before the end of the Construction Contract's <br /> correction period to ascertain whether any portion of the Work or the repair of any damage to the Site <br /> or adjacent areas is defective and therefore subject to correction by Contractor. <br /> 3. Create a new operation and maintenance(O&M)Manual for the wastewater system.The O&M Manual <br /> shall be provided in digital form (pdf format and Word format). Three hard copy manual shall also be <br /> provided. O&M Manual shall include detailed operation and maintenance instruction for the Mashpee <br /> WRRF, the two collection system pumping stations, and the collection system. GHD shall provide two <br /> (2)draft digital copies of O&M Manual for OWNER's review, and two(2)hard copies and two(2)thumb <br /> drives containing the documents in Word and pdf formats) of the Final O&M manual. Provide the <br /> Contractor's complete, itemized and organized set of vendor manuals for each contract including <br /> vendor manuals for equipment item, instrument, and system supplied for the project.
