Chairman, Jonathan D. Furbush, Board Members, Ron Bonvie, Scott Goldstein, <br /> Norman J. Gould, Associate Members, Sharon Sangeleer, George Ganzenmuller, and <br /> Charlie Reidy were present. Building Commissioner, David Morris, and Town Engineer, <br /> Chris Gallaher were also present. <br /> Chairman Furbush opened the meeting at 6:00 pm and announced that the hearings were <br /> being televised live on Mashpee TV. He will take comments after each hearing. Board <br /> Member, Bill Blaisdell, and Associate Member James Reiffarth were absent. <br /> NEW HEARINGS <br /> Sitting in on this hearing are the four regular Board members and Associate Member, <br /> Sharon Sangeleer. <br /> 164 Ninigret Ave: Owners, David W. Nichols and Debra L. Nichols request a Written <br /> Finding under §174-17 of the Zoning Bylaws to allow for construction of a second floor <br /> addition to a pre-existing, non-conforming single family residence on property located in <br /> an R-3 Zoning District, Map 65 Parcel 85, Mashpee, MA. <br /> Attorney Kevin Kirrane represented the owners for the Written Finding request. He <br /> provided his written presentation that includes the site plan and photos of the existing <br /> conditions. <br /> The property is a non-conforming lot consisting of approximately 7,400 sq. ft., and 6,250 <br /> sq. ft. which is upland. The site is bounded on two sides by a street or a way, however, the <br /> way to the West, Sakonnet Drive which boarders John's Pond and other properties are <br /> utilized by most of the property owners. That street has never been developed and suspects <br /> it will never be developed. <br /> The parcel slops significantly from East to West as it drops toward Sakonnet Drive and <br /> John's Pond. The existing structure is a single-story ranch style home with a walk-out <br /> basement and a first floor deck. The structure is non-conforming as it fails to meet the <br /> existing front yard setback requirements from Ninigret Ave., and the side yard setback. <br /> The application request is for a second-story addition which is within the footprint of the <br /> existing building and attached deck. So there is no increase in the non-conforming aspect <br /> of the structure. This structure sits about 26.2 ft. from Ninigret Avenue, 14 ft. on the <br /> Northerly sideline, and 9 ft. from the Southerly side line. <br /> 1 <br />
