Kelley and Seana M. <br /> Pitt requesting a Special Permit under §174-17.1 to raze and replace a single family non- <br /> conforming structure with a new code compliant structure on property located in an R-3 <br /> Zoning District and Popponesset Overlay District, at,30 Uncle Edwards Road, Map 111 <br /> Parcel 179-0, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on July 19, 2019 and July 26, 2019 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 14, 2019 at which time the following members of the Board of <br /> Appeals were present and acting throughout; Chairman,Jonathan Furbush,Vice Chairman, <br /> William Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, and Norman J. Gould. <br /> Attorney Kevin Kirrane represented the applicants for their raze and replace <br /> project. Also present was Tom O'Neil, Designer of the proposed dwelling. The site is a <br /> corner lot that consists of 7,500 sq. ft.,has 93 ft. of frontage on Uncle Edwards, 106 ft. on <br /> Alma Road, and conforms to the requirements of the Popponesset Overlay District. The <br /> existing dwelling was built in the 1950's and has three (3) bedrooms as shown on the <br /> photographs. That building is non-conforming because it fails to conform to the front yard <br /> setback from all streets and ways. The front yard setback from Alma Road is 16.4 ft., and <br /> the side setback is 10.7 ft. The setbacks will improve on the new structure from 16.4 ft. to <br /> 17.5 ft.,and from 10.7 ft. to 13.5 ft. The new dwelling conforms to the height requirements <br /> at less than 25 ft., and the lot coverage at 23% where 25% is allowed. <br /> 1 <br />
