Clayman Page: 347 <br /> 115 Summersea Road <br /> (Map 105 Parcel 72) <br /> Mashpee,MA 02649 <br /> A Petition was filed on June 28, 2019 by Owners, Martin A. and Lorraine A. <br /> Clayman requesting a Written Finding under §174-17 of the Zoning Bylaws to allow for a <br /> deck extension to a pre-existing, non-conforming structure on property located in an R-3 <br /> Zoning District, at 115 Summersea Road, Map 105 Parcel 72, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on July 19, 2019 and July 26, 2019 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 14, 2019 at which time the following members of the Board of <br /> Appeals were present and acting throughout;Chairman,Jonathan Furbush,Vice Chairman, <br /> William Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, and Norman J. Gould. <br /> The Clayman's represented themselves for the deck project. There existing deck is <br /> in disrepair and they would like to replace and expand it to accommodate their needs. The <br /> existing deck is located at the ground level, and is not near the septic system. The deck will <br /> be extended 2.5 ft. toward the rear and will be about 10 ft. wider. Mr. Clayman hired a <br /> contractor that said the existing structure is safe enough to extend. <br /> The Board noticed that the lot coverage is well under the 20%, and the setback on <br /> the rear is remaining at 15 ft. They had no issues with the project. The Town Department <br /> comments were read into the record. <br /> GENERAL CRITERIA: <br /> The subject property located at 115 Surnmersea Road is approximately 9,030 <br /> square feet. <br /> There were no abutters present. <br /> 1 <br />
