David, Trustee <br /> requesting a Special Permit under §174-17.1 of the Zoning Bylaws to raze and replace a <br /> pre-existing non-conforming single family structure on property located in an R-5 Zoning <br /> District,Map 30 Parcels 22 &23, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> ,general circulation in the Town of Mashpee, on July 19, 2019 and July 26, 2019 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 14, 2019 at which time the following members of the Board of <br /> Appeals were present and acting throughout;Chairman,Jonathan Furbush,Vice Chairman, <br /> William Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, and Norman J. Gould. <br /> Mr. David represented himself for the raze and replace project. He owns two lots <br /> and the address was recently changed to 2 Santuit Lane from 137 Shields Avenue. His <br /> project consists of razing the existing structure and rebuild a new structure utilizing both <br /> lots. One lot is in his name, and the other is in the family trust. He has owned the property <br /> since 1980. <br /> Jonathan and Ron questioned the percent lot coverage of the existing structures on <br /> the site plan that depicted 11%. Mr. David said the lot coverage is for both lots. <br /> Jonathan asked the applicant if he was asking for any setback relief. Ron asked the <br /> applicant if he was creating any new conformities. Mr. David said; no. He said that the <br /> non-conformity is that he needs two acres under the current zoning. His current lot has <br /> 8,900 square feet, and by combining the two lots he will have 17,000 sq. ft. <br /> Bill said that by combining the two lots, he is creating a lesser non-conformity. <br /> 1 <br />
