MASHPEE ZONING BOARD OF APPEALS <br />DECISION FOR A SPECIAL PERMIT MODIFICATION <br />(SP-85-03-010) Petitioner, Robert V. Catania <br />(Owner of Record: Kevin P. Andrade, Trustee of the Sununerfield Park Realty Trust) <br />800 Falmouth Road, Unit 101C, Map 88 Parcel 2, Mashpee, MA 02649 <br />SP-2019-49 <br />Ron is concerned with the hours of operation that could potentially become a 24-hour use. <br />Rob said that the Board of Health is involved with any noise related issues. Ron asked <br />Charlie if in fact this application created a nuisance, and someone complained to the <br />Building Department, would he have the authority as the Building Inspector to deal with <br />these issues, Charlie said; yes. <br />Jonathan read a memo into the record from Evan Lehrer, Town Planner dated October 10, <br />2019. Scott read a memo into the record from the Plan Review Committee dated October <br />3, 2019. <br />There were three abutters present who were in favor of the application. One abutter asked <br />what would be extracted from the product. Rob said; that the extraction is the essential oil <br />of the plant. There are cannabinoids, terpenes, and flavonoids are part of the extraction <br />process. <br />SPECIAL PERMIT CRITERIA: <br />In view of the foregoing, the Board determined the Petitioner met the criteria for a Special <br />Permit. Upon motion duly made and seconded at the Public Hearings on Wednesday, <br />October 16, 2019, the Zoning Board of Appeals voted unanimously to issue a modification <br />to an existing Special Permit (SP-85-03-010) under Kevin P. Andrade Trustee of <br />Summerfield Realty Park. The modification is to allow the inclusion of a marijuana <br />manufacturing facility at 800 Falmouth Road Unit 101 C under a Special Permit § 174-25 E <br />(16) (Table of Use Regulations), and §174-24.K of the Zoning Bylaws to allow for a <br />marijuana manufacturing facility located in an I-1 Zoning District (Map 88 Parcel 2), <br />Mashpee, MA (Owner of Record: Kevin P. Andrade, Trustee of Summerfield Park Realty <br />Trust). <br />1. The Board has determined that the applicant meets all the conditions of a Special <br />Permit under Mass General Law 40A Section 9. <br />2. Site Plan: Summerfield Park, Scale: 1" = 30', Dated: Feb. 26, 1985, All Cape <br />Survey Consultants, depicting Location of Facility, Building C, Unit 101. <br />3. New Floor Plans: RESCOM Architectural, Inc., 118 Waterhouse Rd, Bourne, MA, <br />Project: 800 Falmouth Road, Unit C-101, Owner CCE CAT LLC, 35 South St, <br />Mashpee, MA.
