Bk.: 29541 <br />Owner of Record: Evergreen Energy LLC Pg.: 136 <br />588 Main St. (31 Evergreen Circle) <br />(Map 19 Parcel 10-10) <br />Mashpee, MA 02649 <br />A Petition was filed on September 23, 2019 by Petitioner, Cape Cod Dog Center requesting <br />a Minor Modification to an approved Special Permit (SP-2018-54). The proposed <br />modification is to reduce the size of the building, and interior design changes. <br />Notification to abutters was not required. The Mashpee Zoning Board of Appeals issues <br />this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A §9 <br />and the Town of Mashpee Zoning By-laws. <br />Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br />October 16, 2019 at which time the following members of the Board of Appeals were <br />present and acting throughout; Chairman, Jonathan Furbush, Board Members, Ron Bonvie, <br />Scott Goldstein, Norman J. Gould, and Associate Member, James Reiffarth. <br />GENERAL CRITERIA: <br />Attorney Kevin Kirrane represented Cape Cod Dog Center who is the applicant and current <br />owner of the facility at 31 Evergreen Circle. Also present was Conserve who are the <br />contractors for the building. Kailey and Adam Cullen were the recipients of a Special <br />Permit from the Zoning Board of Appeals, and are operating a facility in Sandwich and <br />would like to own their own building. They hired nationwide experts to construct the <br />building, and it appears that the building as proposed by the nationwide architects was far <br />more expensive than ever contemplated. As a result they had to down scale their proposal. <br />The new building is not creating any new zoning issues. The facility will still operate the <br />same as previously approved. The facility is currently at 3,400 sq. ft. and is reduced from <br />4,000 sq. ft., and will be entirely within the footprint of the building that was approved by <br />the Board. <br />The new building will not be creating any new setback issues. There was a future expansion <br />for a second phase that was originally contemplated for a 2,000 sq. ft. expansion, and will <br />be reduced to 1,200 sq. ft. The original design of the building was presented as a stone <br />fagade in the front of the building, with concreate, and a stick built building, and will now <br />primarily be clapboard construction and Cape Cod style. The interior of the building layout <br />has changed as result of the downsizing of the entire square footage. <br />
